A aispatch to the Baltimore Gazette from Parton, ‘Md., states that a Bendish sasaalt and outrage was perpetrated upon Miss Martha Boubiltz, aged 1s years, near Hott- man’s milis,on the Homestead road, about 430 o'clock Saturday alteruoon, and has caused the most intense excitement in this portion of the country. It appears that tne assailant, ap unknown tramp, had been ob- served hanging about the mills, where Miss Boublitz was employed, for several days, and on the afternoon of Saturday, whea she started home, he, it is supposed, either fol- lowed her or concealed himself alongside the roadway, near where the assault was com- mitted. She resided with her parents, and immediately upon leaving the mills, started toward bome. When in an unfrequented spot she suddenly encountered the tramp, a man of powerful physique and forbidden ap- | ance, who rudely accosted her. Tne rembiing girl begged to be allowed to pro- ceed to ber bome, when sbe was radely | seized and an infamous proposal made | to ber, which she indignantly rejected. A desperate struggle ensued, during which the clothing of the unfortunate girl was torn to pieces. For several minutes the struggle continued, Miss Boublitz making a most de- termined resistance, but was finally over- wered, and the wreteh, after accomplisn- ng his purpose. left her in an unconscious condition aud fled. She partially recovered soon after he bad left and managed to reach ber home in an exhausted condition, where she told the story of the terrible outrage, which aroused thé strongest sympathy of all | in the neighborhood, and a few expressions | were made that the fiend, if captured, would | be lypened. This case comes up on a writ of certiorari toa jastice, and the question is | Whether & magistrate’s judgment on the ver- dict of a jury is appealabie, and the court holds that it is not, as it is in contravention of act 7, of the amendments to the Constitu- tion of the United States, and the court granted the motion to quash. REAL ESTATE CASE. Judge MacArthur announced the optaton of the court In the case of Fisk against Bige- tow. This igacase which comes upon ex- ceptions, and arises out of certain real es- tate. The decision below was affirmed. A LEGACY. In the case of U. 8, use of Josephine Torn- burke, agt. Parmer, Judge MacArthurdelly- ered the opinion ofthe coart. Tats is an ac- tion brought to recover a legacy of $1,090 left to her by Julia Kelly, to be paid when she should arrive at 18 years, and having reached that,age she how sues for the amount. It - ge that Joho H. Ford, the executor, filed in the Orphan’s Court a re- ceipt signed by himself ag trustee for the amount, and it was claimed that this ended the transaction. The Court affirmed the judgment below in favor of plaintiff as against Parker, @ surety on the bond of Ford. IN THE CASE OF HUESTIS AGT. GRANT | the decree below with some modifications | Was aflirmed. THE HALLFCK CASE. Jadge MacArthur also delivered the opin- jon of court in the case of Benjamia B. Halleck (convicted of larceny of Ca S47 097, from the Treasury). The action | of the court below in allowing the indict- | ments to be consolidated was sustained; bat in regard to the admission of certain confes- sions the action of the Criminal Court was overruled, and a new trial Is granted. Judge MacArthur said that it appears that Mc- Devitt promised the prisouer that any con- fessions to him would not be used agains him. If Mrs. Bishop is credible, then the allegation that inducements and promises were made is sustained. It appears that McDevitt sent to Major Richards and told bint to go down and receive the confession. The court was of the opinion that any con. _ fession which it was iacompetent for Mc- | Devitt to give in evidence was incompetent for Kichards togive. Judge MacArthur re- marked that the action of the detective and | the lawyer was different; the latter would not, after getting the confession, call in the superintendent of police. District of Judge Wylie anuounced the opinion of the court. This is the 7th street road lmprovement certificate case, and the | court held that the issuing of certilicates for the work was wholly without law, and the certificates, in whomsoever’s hands, are void. itis a@ very important matter fur the protection of the public that their servants | should have their hands tied, and the people would be better off if the officers always act within law. Judge Wylie announced that this case was heard by all the judges except- ing Judge Humphreys. Cook prayed an appeal. OTHER CASES. Eaton et al., which grows out of the purchase of the Mc- #ban property by ex Governor cee, subseqnently leased to the Post Officedepart- ment, Judge Wylie announced the opinion of the court, dismissing the bill. An appeal was prayed. Danby agt. Sharp; decision below affirmed. Godwin agt. Kimunell; bill dismissed. An appeal was noted. In the case of Nichols agt. Barber—action of trespass, assault and battery, and rape— Mr. | Judge Wylie delivered the opinion, over- ruling the demurrer. The case will now go to trial. THE MARKET CASE.
