Tne States are as follows: Arkansas, Florida, Kansas, Minuesota, Nebraska, vada, and Oregon.” Well, in the House yesterday this “noble American statesman,” (per resolution,) Franklin Landers by name, rose and offered the following. «Whereas the repert’of the Commissioner of Internal Revenue for 1573 shows conclas ively that the District of Columbia since 1563 paid, exclusive of the income tax, into the United States Treasury the sam _ of $4,695,190.94, or More than ‘all the other Ter- ritories combined, and more than the follow- ing seven States, each having {wo represen- tatives upon the floor of the United States Senate, namely: Arkansas, Wisconsin, Flor- ida, Kansas, Minnesota, Nebraska, Nevada, and Oregon; aud whereas it is un-Americaa and undemocratic to deprive any large com- munity of Americaps of the sacred right of the baliot and of the right toselect their ser- vants by universal suffrage: Therefore, in consideration of these premises, , That the Committee for the Dis- trict of Columbia be, and they are hereby, ordered to report back to the House as soon a8 possible the bill now before them restor- ing an elective government and a Delegate in Con; to the peopie of the District of Columbia.” And this seven-by nine little demazogue, co-operating with Tappertit Hodnett in de- mandi ng suffrage and soft money or “Blood!” is the man that the (truly) “soft” democracy of Indiana have nominated for goveraor of that great state! ———___-+ee- —_____ The Philadelphia Press, referring to the summary action of the House of Repre- fentatives in the case of Hallett Kilbourn, regards it as pure despotism to compel pri- Yate men to submit, on pain of Imprison- ment, to inquisition. The Constitution declares that “the right of the people to be Secure in their persons, houses, papers, and effects, against unreasonable searches and Seizures, shall bot be violated; and no war- Fant shali issue, but upon probable cause, supported by oath or affirmation, and par- Ueularly describing the place to be searched and the persons or things to be seized.” Tne Press very naturally thinks this article is as much a restraint upon Congress as upon the executive or Judicial departments, and that the House is simply putting the screws to Kilbourn to make him produce what it can- not get under any color of law. The duty of either House in case of contumacious wit- nesses would seem to be plain, as set forth im sections 102 and 104 of the Revised Stat- utes, which require the House or Senate, as the case may be, to place the matter in the hands of the District attorney of the District of Columbia, who, in turn, shall bring it before the grand jury, avd prescribe fine and imprisonment on conviction. It is doubtless true that either House is without the juris- diction of any juticial tribunal in case of @ disregard or positive violation of this law, but it is not equally plain that oue House is justified in setting at defiance a law passed by both Houses of Congress to meet cases precisely similar to Mr. Kil- bourn’s. A republican Congress did this in the case of Joseph B. Stewart, who declined to tell how he distributed a lobby fund of $250,000. He was willing tosay that he never ave any portion of this money to any mem- ber of Congress or to any officer of the gov- €rnment, but positively declined to tell to Whom it was disbursed. For this he was Capitol by @ republican House of Represen- tatives, which never took any measures for his criminal prosecution. This precedent ‘the present House seems to be following in the case of Kilbourn.
