On Satarday after our report closed, Jadze Wylie delivered the opinion of the court in the case of Phelps vs. McDonald, affirming the decision below dismissing the bill. In the enforced countermarches of the army this cotton was destroyed by the federal troops. McDonald after the war was bank. rupt, and fled a petition under the bankrupt act in the southern district of Ohio for a dis- charge in bankruptey. After his discharge McDon- ald, through a middle man named White, | bought up bis accounts in greys for $20. He therenpon claimed to be a British subject, and filed bis claim for cotton de- stroyed before tne Court of Alabama Claims, and was allowed $193,000. McDonald’s cred- itors before his discharge in bankruptcy, among whom was Phelps, the assignee, filed @ bill in equity fora receiver and distribu- tion, &e. The English government placed the amount in the power of the court to await its decision. The court decided that it had no powerover the fund, and even if it had, the discliarge of McDonald as a bankrupt gave the latter the sole right to the sum awarded. Chief Justice Cartter dissented, Ley oom | in effect that while it was true that the fand was a British fand, aud under ordinary circumstances the court would bave no control over it, yet when the action of the British government placed this fund in the power of the Equity court it had the right to deal with it ing to the equities of McDonald’s creditors. There was one int In the ument for the defense, that McDonald, having been discharged as a bankrupt, was no longer liable to bis credi- tors, which would be conclusive tf it were not for the palpable fraud and rascality shown in bis attempts to plead first one nationality aud then another tn defrauding Lis creditors, aud his purchasing his assets for a mere rong. He would never lend himself to indorse the dissent. An appeal was taken to the Supreme Court of the United States. A WELL ExpLopEs.—The Rochester Ex press says: A very remarkable exp! occurred Tuesday morning at the house of Waiter Cook, about one mile from West Bergen, on the Lower Line road.
