WASHINGTON: THURSPAY......January 20, 1976. CROSBY S. NOYES........Editor. BQ Circulation More than Three Fimes that of any other Daily Pa- | Per published in Washington, and therefore by far the Best Adver- Sising Medium in the District of Columbia. Tuterest om the 3-65 Bonds. ‘There is an erroneous impression that there 4s some opposition on the part of the District | the interest on the 3-65 bonds. This is not so— @he only question is as to whether the in- Zerest shall be pald from funds in the hands wf the District Commissioners being the un- expended balance of last years’ appropria- Bion of 1,060,000 or by a new appropriation. The last Congress contemplated leaving the general appropriation to go to other pur- poses, but if this Congress see proper todo Bo they can order the payment of this interest ©ut of money now in the Treasury to the @redit of the District Commissioners. We @re creditably informed that the District Committee are unanimously in favor of pay- ing the interest, the only question being as fo which of these two methods they will favor. Timothy Kirby's W! Stanly Matthews, the distinguished attor- Mey at Cincinnati, who, it is said, narrowly escaped being made Chief Justice when the ame of Attorney General Williams was Withdrawn, arrived in Washington last Right, and ts a st atthe Ebbitt. Judge Blatthews, who !s the attorney of the Kirby heirs in their contest of the will, says there mre several grave errors in circulation in re- Herence to that eccentric document. The ehildren d!spute the will not from any dis- ©ontent with the disposition of the property, Zor the bulk of itis given to the four heirs Byron and Clinton Kirby, Mrs. Donn Piatt, and Mrs. H. B. Bann but from a seuse of duty in a vindication of their father’s mem- ory. For over fifty years Mr. Timothy Kirby Was & prominent citizen of Cincinnati, re- Marked for his purity of character and pro- Priety of conduct. He was a good citizen @nd affectionate husband and an indulgent Parent, respected and loved by all who knew Bim. When nearly ninety years of age, however, his reason gave way, and his con- Guct, like bis will, was the result of insanity. ‘Three out of four subscribing witnesses tes- tify to this fact, and painful as the ordeal is, these grief-stricken children find it necessary to make the fact known, in vindication of their father’s memory. We see it stated by the Cincinnati papers that the probate court has admitted the will to probate, but the judge in doing so said he Yergarded the probate of the will as ex parte and purely formal, and that under ordinary eircumstances a will ought to be admitted 2o probate uniess the testimouy was such as 2o exclude every hypothesis of competency n the part of the testator. In this case, @ithoug’ three out of the four subscribing ‘witnesses testified that their present opinion ‘Was that the testator was incompetent at the time of the execution of the will, never- theless the court thought that it would best Bubrerve the ends of justice to aimit the Will to probate in the usual and formal way, nd aliow the parties Interested to do so, to Contest it in the ordirary way. Gen. Banning, Donn Piatt and Byron Kir- by declined the trust imposed upon them as ®Sxecutors, and Clinton Kirby alone assumed it. In qualifying he filed a statement of the ‘Value of the estate, fixing the personalty at $10,000 and the realty at $100,000. The Ga Bette says: “It was generally supposed that Bbe estate was worth a million anda hair, Aba some persons, pretending to kuow, had Hixed it at as high as four million, and that ‘the ‘adopted’ children got at least half a mil- Hon. But these extravagant fancies vanish before the array of figures in the statement ©f the executer.” The value put in by the executor is probably, however, the assesse4 value on which taxes are paid,or what it ‘would sell for under the hammer. Much of the property !s real estate, the exact cash ‘Value of which Is not easily estimated, bu: ‘which, if well-managed, would doubtiess sel! or double its assessed value. —_-<re-__ Our Relations with S- The New York World contains au accoun @f an interview with Secretary Fish by Mr. J.B. Stilison, of that paper. As the World thas usually spoken with autheotle and dis- reetiy-put Information concerning State Department matters this statement will be Scanned with interest. Secretary Fish did Rot, of course, tell all the secrets of his diplo- matic budget, but he very trankly explained ‘the cbaracter of the communication made to the Spanish government through Mr. Cush- ng. It was purely pacific, and so friendly in ts character that the Spanish Ministers pro- Fosed to take it as a basis for a treaty of . Itrecited what the United Stateshad Buffered in consequence of the protracted ‘war in Cuba, and how patiently it had en- ured till endurance had ceased to be a vir- tue; and it urged Spain to settle the difficulty @t once. It virtually said to Spain: “We don't want to troulle you, but we must take, are of our own.” A copy of this note was ‘@fterwards sent to our ministers in Eqrope, 20 be read by them to the respective govern- Ments to whieh they were accredited, to as- @ertain whether they could each coincide ‘With the suggestions respecting the pacffica- Zion with Cuba which the note embraced. To get the facts directly before those govern- ments, and lead them to use their Influence 4m inducing Spain to settle the Cuban difi- @ulty at once, was the object. The Secretary tieclined to tell what answers had been re- @elved, as that might be discobrteous to the House, which has asked for information, and ‘the information wil! be given in a few days. Mr. Fish claimed that the government has Rot departed from the letter or spirit of the Monroe doctrine, which he attributes to Can- ming, though !t was subsequently written ‘ut by John Quiney Adams, then Mr. Mon- Foe's Secretary of State. 2+ It is to be presumed that there ts but little doubt among fair-minded persons of both parties that intimidation, and In some cases, @ctual violence, was practiced during the late political campaign in Mississippi. But how far sch intimidation and violence was Justified under the peculiar circumstances of the case, it would well be worth while to eousider. A prominent native Mississip- Pian—a republican with conservative ten- @encics—has no hesitation in saying that the “question at the last election was whether “the ignorance and cupidity,or the intelli- gence and respectability of the state should Fule. On this issue the respectabie elements Of the state, both white and colored, united, Grd ig advance, and notwithstanding tue prepor derance of the ignorant masses, boldly Prociaimec their firm determination of car- Fy ing the election at all hazaris. Congress encounters remonstrance, too, in {its proposed reduction of the expenditures of the governmest in the direction of diplo matic and conusularexpenses. It Is asserted ‘What the Secretary of State has expressed the opinion that the wholesale reduction of Salaries contemplated will demoralize qe consular service. It is dificult, even now, to obtain suitable representatives for m: ‘consulates oo Account of the starvation sala- ries attached to the positions. It isa very common belief that mild wea- ther in winter is unhealthy, and yet the last mortuary report of New York city seems to disprove the proposition. For the week which ended last Saturday there were 508 deaths. This was thirty-nine less than the number reported during the week before, and oue hundred and sixty-nine less than that reported during the corresponding pe- riod in 1875.
