It was claimed that Congress gave them the right to use these streets, but Con- gress would not relieve them o* ordinary care. It was in proof that this train occupied the avenue lying across a street for twenty minutes; that the avenue Was impassable. and if it was tcue that the company had been in the habit of allowing persons to cross the train then this party could not be cailed a trespasser. The court held that the instructions below were correct and affirmed the judgment below. MARRIED WOMEN’S PROPERTY RIGHTS. Judge MacArthur, also, in the case of Louise M. Smith agt. J. Harry Taompson, delivered the opinion of the eourt. In this case Moses Kelly held certain property in trust for Mrs. Thompson and she died in ‘2, having made, in January, isil, a will, in which the property is charged with cer. tan bequests aud the lot in question having been sold the biil is brought to quiet title. The court held that a married woman may hold and dispose of her separate estate as a femme sole unless restrained by the terms of the instrument. In this casé the only re- striction is that the trustee should join in the | deed. The conveyance by her was valid in the opinion of the court, but if they were mistaken then Mrs. Thompson had full power under the married women’s act. The court reversed the decree and it was an- nounced as Mrs. Smith had io good taith urchased a portion of the property, that. the nests should be by Mr. Thompson, which was amply sufficient. The court refused to grant the motion, and an appeal was taken. This cou held that there was no error shown, and af firmed the judgment below. In the case of Linville agt. Holden et 2 Judge Humphreys announced tbat because of a divided court the jdgment below was affirmed. Mr. Mattingly filed a motion for a rehearing before a full bene! udge Wylie, for Judge Cartter, announced that the judgment in the case of Ould agt. Rev@iek, was affirmed. Shoemnker agt. Judge Wylie also delivered the opinion of the court in the ease of Brick, executor, agt. Brick. In this case the ownership of 250 shares of gas light stock is involved. The court affirmed the decision below, and an appeal was taken, in the case of Pendleton agt. Parker, Judge Wylie delivered the opinion of the Court i the decree beiow. An appeal was Shafer agt. Leonard. Judge Wylie deliv- ered the opinion of the Court. Tails was an action brought by plaintiff for work done on defendant’s house under a contract with «e- fendant’s husband.
