Keith, judge of the circuit court, has granted an in- junetion restraining the city coune!l from interfering with the railroad track of the sqmplainants within said city, in any way. The injunetion process was served this even- ing. Of course this will prevent the removal of the track until the rights of the parties are settled by the courts, unless the pro- claimed policy of removal “law or no law” should prevail. This would be dangerous to attempt with Judge Keith, and we suppose Will not be adopted. As the case now stands nothing can bedonein it till November 15th, except on a motion to dissolve the injunc. tion, which may be made at any time, on ten days notice to the opposite party. E. B. Ward, on an appeal from the probate court, filed the afti- davit of Milton D. Ward, setting forth that the will was substantially dictated by the = “phe of rere Lyon, father ce . Ward, one of the proponents, and a “spirit” known as “Clara; that Capt. Ward so stated to one Henry Slade; that Slade is now ill in New York city, and petitioning that time be granted for the taking of Slade’s deposition. BFFCHER AND MOULTON.—It is commonly thougbt that the trial of Mr. Moulton on the charges brought against him would be a mere repetition of the case of Tilton against Beecher. This is a terror. Very im- portant differences between the twolie on the Surtace, and more important ones lie deeper. Mr, Moulton, as a defendant, would have in bis favor all those presumptions that form- erly were in favor of Mr. Beech, and that un- doubtedly had a t effect in his favor. But the graver di ces would be in regard to witnesses, Jn this case Mrs. Tilton would not bear to either side such a relation as formerly kept her off the witness stand, and Mr. Moulton would not have those family reasons for not sie hei = borer ses which certainly restrain @ plain: in the former case.—N.
