The paper is not in any case sent by mail unless the money therefor accompanies the order. ——_—___-+e-- ______ “Have ‘ticket scalpers’ any rights which railroad companies are bound to respect?” was the question involved in a late case of the Baltimore and Ohio railroad against one Hilleary, of Cumberland. In March last the company seized twelve tickets over their road from Hilleary, who Is an agent of Balti- more scaipers, on the ground that they were stolen. The tickets or coupons in question Were unuse! portions of through tiekets from Pittsburg to Washington or Baltimore, the original tickets having been used from Pitts- burg to Cumberland only. Tue local fare always being proportionately higher than the through fares, scalpers could buy and then sell these coupons st a profit. Mr. Hil- leary recovered the th s through the de- cision cf a Cumberland justice of the peace, Which was to the effect that the holder of a stolen ticket, provided he is an innocent third party, becomes the owner of it, and the company must accept it at its true value, the same as any other negotiable paper. Not content with this decision, the com- “pany sued ont a writ of replevin for the tickets and carried the case to the circuit court, Which has decided that tickets from Pittsburg to Wasuington, after having been used as far as Cumberland, are not salable by the holder to a tulrd party for transporta- tion to Washingtoa from Cuimberiand, and that the company is not compelled to take them if It can identify them. Should this decision be sustainel by the higher courts, it will have the effect of breaking up the business of the scalpers. The latter assert, however, with great reason, that it will not be be sustained, and that ifa passenger Wishing to go to Camberland from Pittsburg chooses to buy @ ticket gool from the latter city to Baltimore or Washington, and when he arrives in Cumberland selis the unused coupon or coupons, the scalpers claim that there is no way In which the company can evade the honoring of the latter. This point bas already been so decided, we believe, by the higher couris of Illinois. —+20e- New York city is grumbling again because the state census just completed does not give ber a population of 1,500,000. She was dis- satisfied in 1570 when the general census was taken, and insisted so strenuously on another count that Superintendent Walker finally Sielded and reenumerated her inhabitants. ‘The result scarcely justified the extra exp2n- diture, sinee after a thorough canvass the aggregate population as shown by the first count was not materially increased. While the late state census was being taken many of the city journals predicted that the re- turns would show a population of 1,500,000, the lowest estimate -being 1,200,000. The oficial returns just published show the popu- lation to be but 1,061,272, which !s an increase Of 91,166 over 1870 About 30,000 of this in- crease, however, is accounted for by the an- nexation of the lower part of Westchester county about year ago, so that the real in- crease of the New York as it was in 1570, in five years is about 60,900. A perusal of the £gures shows a decrease only in the second, fourth, sixth, eighth, and fifteenth wards, and an increase In the nineteen remaining ‘wards, most of which are “up town.” The heaviest increase is shown in the nineteenth where it is set down as 39,196, and in the twenty-second, 13,029. A committee of the Pennsylvania legisia- ture is investigating the subject of alleged short weight by retail coal dealers in Phila- delphia, and among the seemingly well-sus- tained charges Is this, that in twenty-five instances cited the consumers paid an aver- age of sixty-one cents on every ton bought by them for coal which they never received—ia other words, the “shortage” amounted in money value to about the sam named. it is estimated that a million tons of anthracite are sold by retail in Philadelphia every year. The Lever truthfully says that the man who honestly gives 2,240 pounds of coal for a toa cannot compete in price with those who give three-fourths of that amount, or, indecd, any considerable amount short of a full ton. With all consumers of coal and the honest in the retail trade against those knavishly in- clined, as has been exposed, there ought to be little difficulty in purging the trade toa reasonable purity. It is not known yet what remedy the committee will propose. —___-*ee- The New Yorkers are @ hard-hearted set 0° varlets. A dancing bear and bis keeper were recently arrested, bat both were discharged on their personal recognizance, the magis- trate seeing no cruelty in the case. In Wash- ington we do things differently. A similar arrest was maie here a few months since, and the keeper was duly ‘ined for cruelty, Which consisted in making the animal per- form by means of a@ large iron ring through his nose. Attached to this ring was a small rope, and it was only necessary to give this a sudden jerk to make the animal dance in the liveliest manner. This expedient as regards cruelty is equal to that formerly practised in Italy, Where turkeys were learned to dauce bya fire under the tin flooring of the cage in which they were confined. —- They manage those things better in Eng. Jand, as well as in France. Colouel Baker, charged with an offence against a lady in a railway car, a few weeks ago, was yesterday found guilty of an indecent as;ault and fined $2,500 and sentenced to imprisonment for a year. British justice is a good thing, as well in its promptness as in its certainty. The ehances are that in @ similar case in this country the offender wouk! have been allowed to go at large on ball, and tuat the trial would bave been put off by hook and by crook until the public had lost all interest in the case, if it did not finally go by default — The colored people of Indiana are raising high caddy over the arrest of certain white men who have married colored women, and intend to test the constitutionality of the Jaw waich prohibits miseegenation.
