Among other things Beach quoted from one of Beecher's talks, in which the latter said he would rather have been the prodigal son than his brother, who was too stingy to get drunk and too anaympa- thetic to sin laseiviously. This quotation Mr. Shearman protested against as an out- rage, but he was taken all aback by the judge. who said he had read it in the Chris- lian Union, which is the official organ of Plymouth church. Mr. Beach also severely criticised the position of Mr. Tracy, one of Beecher's counsel, who bad in his first con- neetion with the seandal gained Tilton’s con- fidence and afterwards, in violation of a pledge, became counsel for Beecher, and finally a witness against Tilton. The ques- tion of re-opening the case to admit new evidence being introduced, counsel for defence made no objection, and Judge Neil- son said he would examine the affilavits which counsel for the prosecution had to sustain the application, and would decision to-day.
