Hill and others, sbenezer Colored Station of the Methodist Episcopal Church, in Washington Conference, against W. H. Brown, to remove cloud on title, &c. The bill states that the complainants with the defendant constitate the beard of trustees of the station; that for Many years they and their predecessors enjoyed the full and uninterrupted use and occupation of that parcel of land known as lot 5, square 820, claiming title to the same, which they inclosed as an appurtenance to lot 4, on which the church edifice stands; that both lots were assessed in the name of Ebe- nezer Church in the year 1855, and so stood until i874; that some time in 1855 the trustees received notice from the Tax Collector's office that each of said lots had been assessed ‘with special taxes for pavement and curbing of 4th street—lot 4 with a tax of $114.21, which was paid May Sth, 1856, and lot 5 for $6 The church and trustees bein; were called for, he 4 y other demands of a pecuniary character, Were not in funds to pay the last-named tax, and the defendant being then, as now, a trustee and fully conversant with the facts, voluntarily offered to advance the necessary amountof money in order that they might pay said tax on lot 5, which proposition was ac- cepted, and the said trustees accordingly, on the 8th of May paid the amount, $70.69, from the money loaned by Brown. That, at the quarterly conference held in May, 1456, it was distinctly agreed and understood that, in order to reimburse and secure him, he might use and occupy the lot until the money was returned to him, and in pursuance of said agreement he secu jon and continues in possession, using the same for stabling and gardening purposes. That they believed that he would surrender when pos- session should be properly demanded, but in February last, when they invited the defend- ant to make known his claim by a commit- tee. he unequivocally disclaimed any and all interest in a title to said lot, and his only claim was for the money advanced, and this he subsequently stated to the meeting to which the committee reported. That in the same month a duly authorized commitice Waited upon him and tendered the amount which he had stated was $75.74), but e refused to receive it, and they then demanded Possession, which he refused to give, and in turn demandea that plaintiffs should prove and establish their Utle. Mat- tingly, esq., intends at an early day improv- ing it with a very handsome residence. ee ALMosT A SERIOUS ACCIDENT.—Yester- day afternoon a peculiar collision occurred between the limited express trains from and to New York, while passing each other, about twenty miles this side of Philadelphia. in turning a curve the rear car of the New York train struck the rear car of the Wash- ington-eound train, shivering the plate glass windows along its side and —. off part of the roof. It would seem that a similar accident jiablé to happen at any time, as the speed at which the trains are run is liable to swing the end cars of the train so that in running en a curve they may be swung together.
