The case in question was the Baltimore & Ohio railroad, plaintiff in error, against the state of Maryland, and the merits of it as follows Since the completion of the Washington branch roadihe company had paid one-fifth Of passenger receipts to the state, in aeecord- ance with the requirement of the charter 0 282, until the decision of the United States Court im the Nevada case, about 1888, de- elaring unconstitutional the exaction made by that state on passengers by a certain transportation line passing thence into an- other jurisdiction. The company then re fused to longer pay this tax, alle: zing its un- constitutionality and the state sued to re cover, but were beaten in 1570, the Superior Court of Baltimore declaring said capitation tax unconstitutional. The Maryland Court of Appeals subsequently reversed this deci- sion, when the company carried the case to the United State Supreme Court.
