Yesterday, in the Criminal Court, Judge ss . after Tar Sran's report of tue trial of Hiram ©. Whitley, Richard Harring- ton, ana Asthar B. Williams, charged with con. piracy in connection with the alleged safe bur- giary in the District Attorney's office had closed, and aiter the usual Mr. Riddle continued his argument. Hesaid had come to Hayes, who in this case came as @ man who bad a correct story to tell, who never contra- dicted himself, and was rarely con- tradicted b: y other witness. ith the ex. ception of the mistake about the day of viewing the safe, when Harrington was at Welcker's, if that i# # mi-take, bis story has been corrobo- rated by every witness on this stand. His te timopny was more fuil here than it was before the investigation committee, but it was not covtradi in asingle instance. The govern- ment did not bunt bim up to come here and testify, but he came here of his own accord and gave testimony of his own volition, and gave it truihfally. The defence put forth several wit- nesses, all Defouled with the slums from which they came, to say they wonld not believe Haycs | | on osth, but many more respectable mon came here and said they knew of no reason why | he should not be believed. Mr. Riddle then read the telegram, dated on April 6th, signed by Whitley, saying, “Ara sick. There is Plenty, of evidence Hayes did meet Whitley in New York the 6th of April. Mr. Harrington.—He was sent away by the Solicitor of the Treasury. Mr. Davidge.—Ob, it does not matter. Mr. Kiddle continued, saying that after Hayes had been before the conimittee and tea titied to being sent here by Whitey the sixth o April, Whitley was before that committee twice atter Hayes was there, and never once alluded beence from New York on thst day. | Mr. Riddle sifted the evidence introdaced to show that Whitley was in Boston that day, and said it was of very little importance, as all of the evidence was forced up and hunted up six after it had occarred. Zorruth told Motzger about it, Hayes told Carter, and Garter id Madge, and yet none of the efforts put forth thwarted it. At this point, Mr. Riddle having spoken about four hours, the court a: journed. To-day’s Proceedings. This morning the Court was vpened at ten ovclock, and there waa a very large attemiince, particularly of members of the bar and promi- nent citizens. Mr. Riddle resamed his argument, imme- diately on the opening of the Gu They had proved that soon after Hayes arrived here ho reported to Nettleship by Carter. C irior wes con- tradicted by nobody. Mr. Ki die then argued that Hayes obtained powse-siog ot the knowledge of the books from Nettlesulp. ‘The amount of money to be paid for the book ‘was not important, the simple object of the con. spiracy was to get Mr. A. to ee to receive, and to receive tne bouks, and thereby crush ont of existence the active engine opposing them.
