Taylor testified that he is clerk in the office of the Second Controller; has had the ac counts of H. C. Whitely to pass upon since 150 have seen bis signature to accounte, sever: hundred in number; have seen his hand writing to notes appended to his accounts, and is some- what acquatnted with his hand writing. A memorandum book was here shown the witue-s for identification of hand-writing, when counsel for defence objected. The Court here ques- | tioned the witness as ro bis familiarity with the hand-writing of Mr. Whitely. Witness testified that he bad seen the signatare before, and that it bore a strong resemblance to Col. Whitely’s signature; this resemblance was very oe and he was willing to say tothe jury that it bears a —— resemblance to it, yet he would not swear to it positive! A letter was here shown witness, wher wit- nese stated that the resemblance did not'bear bim out in ssying that the writing was his.
