Dail-y sworn.—Witnege recollects that on the 7th of May went with Hayes to Newark, on his suggestion, to watch and take notice of what company he (Hayes) got in; went to Net- tleship’s house on Pennsyivania avenue, and | Hayes went in, witness waiting on the opposit> side of the street. Saw H. anda man, a large man, (Nettleship,) through the window: they | talked about an hour; N. came out of the house | and walked with H. to a street car; came close to witness; met Hayes at the depot. On arriving m New York they went to west 21st street, Somerville’s house, when H. went in and ra- mained about 1\ hours; Hayes, he thinks, left New York on t nday fo lowing. Saw him (H.) again on the 12th of Jnne; previous to Hares going to Canada, an arrangement was rade with witness by which La (Hayes) coa't communicate with his wife; recollesta seeing Hayes on the morning of the 24th of May; was with him the best part of the day. Mank between the 20:n h of July; Steinberg had previousiy been asking witness about ® man named Hayes; Mank came to witness and introduced him to Whitley, who said that they wanted evidencs against Mike Hayes; that they were trying to make out @ case against him Sor the govern ment; witness referred him to Nettleship ant Mank met N. several days after; N. asked if be knew Daile: wid he cid not; N. said, “1 want you to go down and get acquainted with Dailey, for he has been in Washington ore the grand jury with Hayes’ wife;” went down for ten or ‘tweive days, but couldn't tind oat anything; ‘‘eouldn’t work bim;" saw aman named Becker there and told Nettleship that Becker might find out what was wanted; N. teld him to bring Becker up. and he did so and troduced him to Nettleship in the presanca of Mank; N.sent Becker up to Whitley, and B went up and remained there ten or twelve m’ utes; Becker went with witness to the office several days afterwards, and B. had interviews with Nettleship; they exciuded witness because he wae not a mason; about a week after Mank’s and Mr. Sullivan called on witness, and took him to Nettleship, and N. aeked him where Becker was; witness satd at Long Branch, and Was sent b; ~to go after him, and retarned with him; Mank wrote out an affidavit for Which Becker wasto receive $150, (ruled out;) Nettleship said he wanted the affidavit signed, but did not want to pay any money beforehand: Becker went away; believed that he(B.) was working with Mr. Wilson, the solicitor; the afi dayit was about Daily. Cross-examined.— Witness did not P, by the name of Stepsey; had not been called “dutch George,” was called sometimes by friends “German George;” never had been engaged in the banco business; don't know what the busi- ‘ness is; was arrested once for disorderly conduct and fined ¢3; knew Hayes by sight before he went to Daily’s. TESTIMONY OF MICHAEL ¥. BAURR. Michael D.
