T. Tune) marie a side remark which was heard by Judge Humpbreys, and at the conclusion of the trial the juror was called up and Jadge H. proceeded to impress upon him the duty of juror keeping a clear bead during attendance, and intimated that if he observed any indica- tion of a juror being under the inflaence of ltquor in ruture he would direct the discharge of such juror immediately. Mr. Tune remarked to the ‘court:—Why, Judge, I bave heard people say that you drink.” The court directed | that Tune’s name be dropped immediately. ‘Tone went out apparently out of temper, if not out of tune. J. P. C. Shanks, member of Congress from [n- diana, and directing him to come immediately and devise means for getting the sick man ont of this aimost maccessibie locality.
