Mr. Smith said to relieve the board he would withdraw his name. The resolation was amended by inserting the name of Solomon G. Brown in place of Mr. Smith, and adopted. Mr. Champlin offered @ number of amend- ments to the rules; which were laid over till the next meeting. This is a suit arisi information filed in the Police Court to enforce the provisions of the act ot the legislature of the District of Columbia approved June 23, 1873, and exhibitions in the sale et This act provides that after the opening for the reception or entertainment of persons of any show or public amusement for which money or other reward is received, it shall be unlawful for any persoa to sell or per- mit the sale of such serve any particaiar seats,or to mark or de seribe as reserved any seats which have not been reserved by the sale of tickets therefor previous to the opening; and imposes a penalty of from five to ten dollars fer each ticket or seat sold or marked contrary to the provisions of the act. The defendants, lessees of the National Thea- ter, were advised to disregard the enactment as unconstitution: nd they did so, Thereupon, they were arraigned before the Police Court. where a judgment pro forma was entered, and An appeal taken to the Oriminal Court; thence it was certified to this court for the final adjuiti- cation of the questions of law involved in the controversy. The defendants submit that the enactment under which thes proceedings hava been instituted is unconstitutiona!—null and void, and the proceedings themselves are unan- thorized; and assign the following reasons:—1 The aileged offence is not cognizable by the Po- ice Court, aud that tribunai is incompetent to exercise jurisdiction in the case. 2. The legis- lative re of the District of Columbia, which passed the enactment, was an unconsti- tational body, and its enactments are wholly in- yalid. 3. The enactment itself is an unconsti- tutional and unauthorized violation of the rights of private property. There are grave reasons tor doubting the constitutionality of the Police Court. and this point they discuas, referring to the third article of the constitution, which pro. vices that judges shall hold their offices during good behavior, and the trial of all crimes shall ba Ns jury. while the act establishing the Police Court limits the term of the judge to six years; provides that prosecutions shall be ca information without fnutctment by tbe grand jury or trial by petit jary, and that the ‘court “shall have orig’ nd exclusive jurisdiction of all ofterses inst the United States committed in the District not deemed capital or otherwise infamous, and all offenses Against any of the ordinances of the cities or laws of the Levy Court. They claim that this act clearly attempts to vest in the Police Court & portion of the judicial power of the United States, and yet it has been decided that courts in which the judges hold their offices for a term of years are not constitational courts, much less 80 are cour‘s unprovided with a jury. Admitting that the Police Court is valid, there is still the objection that it has not jurisdiction, for the inferior conrts of the United States are re- stricted to the exercise of such powers as Gon- gress has specifically conferred upon them, and are not entitled to exercise general jurisdiciion. Now, there is no provision to be found any- where auttiorizing the Police Court to take cognizance of violations of the enactments of this Legislative Assembly. _The Legislative Assembly of the District of Columbia was unconstitutional body, and its enactments are invalid.
