In the case of Hodnette vs. the West Saratoga Union, No. 3, Teceivers were appointed and the assets collect- ed. There were a number of judgment credit. ors and others who simp!y proved their claims before the auditor. All the judgments were obtained after the appointment of the receivers. It appears that a bank had discounted the paper of the association to a large amount, and claimed that they should have preference in the distribution of assets over the other creditors, om the ground that these creditors had been members of the sssociation and withdrawn, some betore and others sul-equent to claims of the bank who had discounted their paper, on the genera! ground that the members of build- ing association were quasi partners, and that ail debts contracted by them sbould be paid in | preference to those other members in withtraw- | als.
