FRIDAY... “Whe Are the Usarpers?” The Baltimore American, while convinced that the legal processes by which Kellogg gained the possession of the gubernatorial chair ‘m Louisiana were irregular snd extra-judicial, cannot find any justification tor the conspiracy which bas deposed hundreds of officers by vio- lence who were legally elected, for the purpose of compelling the abdication of Kellogg, whose title to the cftice of governor 's disputed. The leader of the movement, who now claims to be the acting governor of the state, was not a can- didste for the office of governor in 1572, and no votes were cast for him. He ciaimsto bave | been elected lieutenant-governor. By whatlaw, or custom, or precedent can he now assume the office of governor, and procee:: to the discharge Of executive fanctions? The office of lieaten- Snt-governor is subordinate to that of gover- nor; the one is the alternate of the other in cer- tain contingencies, but the principal must first | be sworn into office before the alternate can presume to act for him. If the governor should die, or resign. or temporarily vacate the execu- tive chair, then the lleutenant-governor can ‘ili his place: but for a person elected lieutensnt- governor to take possession of the office of gov- ernor by violence, and todemand the allegiance le when his principal has not been usurpation far more flagrant than that of K«llogg. ‘The partisans of Penn, the American anys, should also bear in mind another fact that | seems to be lost sight of in the current discus. ston—the seizure of the state government at New Oricavs was only an incident in the great conspiracy. In most of the parishes of Louiai- ana the officers were elected by decisive major- ities. In the northern section of the state, as well as in the “river parishes,” the local gov- erpments were mostly in the hands of the re- publicans. There was no question as to the legality of the election of these o‘ficers, but the conspirators were determined to get rid of them. They were driven from their places by violence, and in some instances were murdered. In this way all the offices im the parishes filled by republicans were vacated. Coneete that Kellogg did not receive s ma- jority of votes; how does that justify the over- turning of parish governments and the murder | of parish officers, who received, in some in- stances, three times as many votes as their op- ponents? What claim have the men who are | now being installed as officers in all the revolu- | tionized parishes to the places which they have gained by violence, and, at least inone case, | by murder? If an asileged illegal count of | Votes is to justify the sweeping away of a state t and the inauguration of the oppos- ates, what should be done with the hew parish gouernments which are being organ- ized from day to day throughout the state of | Louisiana’ | The instracuons telegraphed by the Presi- dent to Genera! Emory in New Orleans to-day and printed in this issue of Tue STAR, are to the foint, and so clearly expressed that there can be ne posible mistake in construing them, Kellogg is to be supported by the military forces in recstablishing the state government as it was before the late emeutr, and if at the end of the five days specitied in the recent procia- mation there is any resistance to the authority of the state, the surrender of the insurgents “must be enforced at all hazard: The Powers and Rights of Corpora- tions. ‘Tue recent speech of Senator Carpenter upon the power of the state to govein corporations of tts own creation, has attracted much attention both from the ability and thoroughness of the | review of the points at issue, and the fact | that the subsequent decision by the Su- | preme Court of Wisconsin against the rail. Toads, was in general accord with his argu- ment. The main points in this argument are— | lst. That railroad companies are the mere crea- tures of law, drawing their breath of life from the law alone, capable of doing only what the | law permits them to do, and holding their lives aud thelr powers at the mere will and pleasure Of the legislature. 2d. That the business these companies are engaged in is one which even natural persons could not carry on without per- mission of the legislature. 34. That the com_ panies are obliged to carry passengers and freight for reasonable compensation, and sub- ject themselves to suit for damages, and to a forfeiture of their charters, if they fail to do so ith. That railroads are pablic highways, the | title rested tm the corporations, that the companies are merely the ageute of the state for the operation and | management of these great highways; that the money invested by the companies as compenss- | tion for lands condemned, or right of way par- | chased, aud to build, equip, aud operate the | road, is regarded as consideration paid to the | state for the franchise conferred by the state upon the companies. That the char- ters granted under the state constitution are Rot protected by the constitution of the United Stater, ss construed in the Dartmouth College case; but may be altered or repealed by the legisiatare at any time. It is a well established doc- | trine of the law that everything falling within what is called pudlici juris—that is public prop- erty—is subject to legislative control. Bridges, turnpikes, ferries, mill-dams, and fisheries are illustrative subjects. And when the charac- ter of railroads is sscertained to tall within | this class of property, legisiative control is | matter of course. The power of the legislature te control railroads must never be abandoned by the people. It appears that the legislature, while tinkering at some amendments to the law, inadvertently left out the operative clause in the re-enactment, This defect having been recently discovered, there is much excitement among the temper- ance people as well as those opposed to probi- dition.
