Winter testified that he was employed by the board in making out special assessmenta, and he had every rea- fon to believe the bill in question was trie and correct. He explained that the whole cost of the improvement on H street, between 7th and 13th streets, was divided by the number of front feet thereon—church and school property being first dedueted—to fix therate. The charch property was exempted by an act of Oongress. Mr. M. Frank Kelly, sworn:—is assistant as- ssor of the Board of Public Works; ths bill of Mr. Clark was paid at the same rate as other Property on that street. Tr. Mr. Clark may be unfortunate in residing on F street, where churches are, but ecclesinstically he may be benefited by living directly beneata the dropping of the sanctuary. Snell is not a duly commissioned judge under the co: stitution of the United States; that said Police Court is not legally constituted for the trial of offences by jury, and the law of January 17th, 1870, does not vest that court with the right of trial by jury. Judge Cartter said that he would be very siow to decide that the act creating the Police Court is unconstitutional, and turn all the thieves and rogues loose on the community.
