Judge Wylie made a decision as to takiag testimony for the court. In this case Driggs suit to enjoin Daniels from negotiating certificates of award issued by a South et = Driggs claimed that he Daniels to prosecute his claim before ‘tment, but he rendered no ser- Daniels answers that he did render ser- vices. vice by employing certain parties who had great influence at the State department, and sac- the awards. The case was referred to Examiner Craikskank, and, after Mr. Daniels had given his testimony in chief, he was, on cross-examination, asked in refer- ence to the parties he had employed, as alleged, but he declined to answer. The examiner certified the case to the coart, and it was decided that he must answer the in- terrogatories. Subseqaently, Mr. Daniels elect- ed that rather than answer the question ani pein the names of the parties referred to he would withdraw his deposition. And this being certified to Judge Wylie, the court to-day de cided that ‘nothing is regarded as evidence in the cause but what is read. If a party, in whose behalf a deposition has been taken, does not choose to read the examination in chief, the other party is not extitled to read the cross-ex- amination. (Smith agt. The room con- tained empty coal oil barrels, boxes, and one Owing to the combustible material with which the apartment was filled, the fire was hard to extinguish, but by the en- | ergy and perseverance of our firemen, the flamas were contined to the room in which they origi- nated. The damage is slight, and will not ex- ceed $75. The stock of Seaton & Bro. ix in- sured for $3,000. The fire was undoubtedly the work of an incendiary.
