The case was that of the “ Potomac Building Association against Grant and wife.” The case is similar to the one in which the same judicial authority gave an opinion some weeks ago, and which was noted in Taz Stan at the time. The excep- tions to the sale were reported by the trustee in June last, and number twelve. Judge Pink- ney, in his opinion, says it is necessary to con. sider but one of these exceptions, the seventh which is :—‘‘ Because an appeal was prayed and an bond proved, and a proper Amdavit was fied in the cause prior to the time of the sale reported in this cause, and due no- tice thereot given to the trustee prior to said sale. adge Pinkney says it is admitted that the trustee bad due notice on the day of sale, but | before the sale took place, of the filing of an appeal bond in these cases, duly approved by the clerk of the court, but it is maintained. “that one appeal having been taken by ‘both defendants, Grant and wife, and the bond beta given by Grant alone, it wae not sufficient the execution of the decree and order.” pd “that the clerk did not endorse on the bond the fact that one affidavit required bylaw had been filed, as he was required to do by rule No. 45 of this court.” judge Pinkney does not think there is any force in this point. A letter from Cumberland says all the coal ! companies have stopped shipping coal by canal except to fill orders given some time ago. As | the season for canal navigation has nearly closed, and im fact may close any day, it is searcely probable that the shipments this year will come up to those of last year. The decrease for the season, which ended on the 6th instant, | a8 compared with that of 1572, was 40,727 tons and Ziewt. As during the week which ended the 6th inst., but 2,375 tons were shipped, and as but one or two weeks remain for navigation, it will be seen that it is improbable that the de- | crease mentioned can be materially affected. A large number of new boats were placed on | the canal last summer, and upon this fact, pro- | bably, President Gorman based his prediction | that the shipments for 1573 would far exceed | those ef any previous year. This prediction | would doubtless have been fulfilled if he had | used due diligence in keeping the canal open.
