Buchanan, and | they further find that the shooting was acciden- tal.’ Buchanan was then discharged, but was mubsequentiy rearrested by, Officer ‘Kenner. charged with an assault and battery on Daniel Dines, and was locked up for a oaring. Officers Kenner and Markwood, who sum- moned the jury, failed, it seems, to get im- tant witnesses before the inquest, and the impression of the officers and the jury was that a full statement had not been made on the hear- ing. Officer Kenuer, after he had rearrested Tines and questioned him, became awate that the most important witnesses had not given their testimony before the coroner's inquest, and this morning he brought the w' be- fore Mr. Closs, who, to the conclusion that it was A CASE OF MURDER, and accordingly has made out a’ new warrant against Buchanan, charging him with wilfall murder. Buchanan was oe gee at the police court and pleaded not guility, stating that he ad been discharged once. ‘The judge replied that the court before which he was tried was not the court to make a fina! decision in sach cases. Officer Kenner testified that he rearresied Buchanan. Mr. John Rye testified that he lives in the neighborhood ‘of the honse where the killing teok place, and saw Buchanan go into his house and heard him say, Apna, if you den't get ont of the way I’ll shoot ySa;" heard a dis- pute and in a moment heart a shot fired. A boy named Braxton testified that he heard Buchanan say that he was GOING TO SHOOT SOME ONE. Daniel Dines testified that he was on the cor- ner of the street taiking with his brother when Buchanan came up and threatened to shoot him. at the same time drawing out a revolver. He then went into his house and in a few min- utes he shot his wife. Buchanan said he had some witnesses, but they were not present in court. He denied ever making use of the language charged by the witnesses. The judge committed him for a further hearing, remarking that it looked as if it might be either a case of murder or man- slaughter. Se Tae 9TH Street Pavement Case—The Answer of Hewitt, Lewis & Co.—The respondents m the case of W. B. Parisen, who filed a bil! few weeks since, in the Equity Court, against Thes. Lewis. D. F. Hamlink and R. C. Hewitt, for an injunction to restrain them from repair- ing and completing the 9th street pavement, have filed their answer.
