The policies were what are known as ‘participating policies,” and the pre- miums, falling due on September 20, were to be paid one-half in notes and the balance tn cash. Incorporated in the policies were the usual | ¢elauses of forfeiture in case of failure to pay the premiums. After Mr. Dean’s death the com- pany refused to pay the widow the amount of policies, on account of the non-payment of pre- mivms, but it was shown by the plaintiff that before the last premium was paid, an extension of the time of payment to the November follew- | ing was ae by the general poe of the company; that then only one-fourth cath was to be paid, and the balance in notes at thirty and ninety days. The company denied any such agreement, and contended that, if matle, the company was not bound by it. ‘The legal point | involved was whether the company was bound by the action of its general agent. The court | held that the general agent could not revive a | poliey which had lapsed, but if the agreement was made before the date of payment, as was claimed by plaintiff, it was binding on the company and kept the policy alive. On the questions of fact as to whether the agreement was made, amd, if made, was it made before the policy lapsed, the jury found in favor of plaintitt, giving her a verdict for $17,192.33. ee ns Bad News For Mrs. Gamp. A charitable association in New York has | lately entered upon the good work of substita- | ting a better class of nurses for the Mrs. Gamps | who have so long infested the sick room. The ladies who form the visiting committee of the association, the Tridune says, have been re- peatedly impressed with the great lack of trained | narses, by Feason of which the condition of the sick is needlessly aggravated. The ignorance and indifference of ordinary nurses, the irri- tating and depressing influence they exerted upon sensitive patients, were often found to neu- tralize the best efforts of skillfal physicians. } It was also recognized with some mortification that we are behind the rest of the world in this respect. There are numerous training schools | for nurses in England, and on the Continent, where capable and intelligent women are pre- pared for the delicate offices they are called to | perform in the sick room. These educated | fF nurses are found of the highest value, not only iz hospitals but in private families, where, in arden exigenctes, their skill and self-possession are infinitely more advantageous than the ex- cited and nervous efforts of the tenderest affee- tion. He decided that the Jury was illegally drawn, and then adjourned the court sine die. The effect of this will, be, unless there should be some legislative inter. ference, which is in the highest degree improb- able, to prevent the holding of any court of general sessions until February, 1874. The Senator-elect is thus safe from prosecution by the state for a year to come.
