In Pennsylvania there is astatue which gives a wife the right to bring an action for maintainance against a husband who refuses to support his family, and judgment | being entered against him for a certain specified som per week, he is bound to give security for the payment of the same, and failing in this he is sent to jail. Under this statue a certain Mrs, Williamson brought suit against her husband who had deserted her and married another wo- man. It was proved that the parties were mar- ried in Antrim, in Ireland, by a Catholic priest; that they lived together sixteen years, and had born unto them seven children before the hus- band deserted his family. As a defence the counsel for the delinquent husband set up a Statute passed in the reign of George II, which provides that any marriage celebrated after the first day of May, 1746, between a “Papist” and &@ person who professed to be of the Protestant faith shall be absolutely null and void.
