Indeed, when has it not been doing so for the Inst fifty years ? In 1828 we had a bankrupt. act; im 1841 another, and then in 146% snother, which is the present law, supposed at the time of ite passage to be a piece of permanent and well-advised legislation on the subject, aml an end of our experimenting to do with and to do without a law of this character. While in Eng- Yand they have had a bankrupt law for a cen- tury, and in all countries where there is anything like an enlightened system of jurisprudence, it is regarded in some form as indispensable in a trading and commercial community; here we are constantly enacting and repealing these statates as the pressure of the classes interested is bronght to bear with greater or less weight upon Congress. Shall we ever bedone with this shnttle-cock sort of legislation, which is so frait- fl a source of evil to the just administration of the laws and the rights ef trade? We saspect wot wuatil Congress acquires strength to resist the of the present day and deny all de- mamis for class legislation. ‘There is great opposition to the bankrupt Inw amoug certain classes of business men with whom it interferes in their methods and chances of collecting debts of failing customers. They are mostly your sharp. hard-going creditors, whose maxim is that the time to collect a debt is when itisdue. They trade or loan on short time, have all their agencies arranged to make prompt collections, aud expecially to make their moner out of a failing creditor in the shortest possible time, and they know how to doit. The bankrupt act has two objects. One is to give the insolvent debtor his discharge on his paying tifty per cent. of his indebtedness, and the other is to secure a fair distribution of the insolvent's estate amongst all his creditors. It does not | allow one or two men, more fortunate in obtain- ing information, by their diligence te take pre- | eedence of others and swoop up the entire es- tate of the insolvent, or to obtain preferences by way of mortgages, deeds of trust, &c., to the prejudice of a score of others who are equally entitled with them to a share of the debtor's estate. When a man is insolvent—and that means inability to pay bis debis—the bank- rupt law throws its protection, when invoked, over the estate, aml says to the surrounding crows of eager creditors, “entlemen,there must we no gtabbing here; fair play and a pro rata what is left for you Any preferences obtained within four monthsofthe bankruptcy, with knowledge of tho imolvent condition of debtor are void, and money or property so obtained must be returned to the assignee for general distribution. Now, such a law designed to protect the rights of all | creditors and insolvent estates from the dili gence and sharp practice of attorneys and cul- jection agents of our commereial cities, does not suit the class of business men we have named. If the debtor has stopped payment they want to proceed at once to be the first to issue execution and make levy, first totake their pound of flesh, and they are sure to take it from the center of vitality in the poor subject, so that whoever comes after, on a similar errand, will find noth- ing but a bleeding and exhausted carcass that will not pay funeralexpenses. Before the bank- rupt act went into operation these gentlemen always had @ sortof monopoly of the proc of the estates of insoivents. They were keen- scented and swift-footed, and always obtained the tion's share in a commercial failure. They were enabled generally to make their money or well-seeure it before the body of the iters hat any definite knowledge Teal condition of the debtor. ntlemen don't want a bankruptiaw; it is im thetr way, and anobstacle to their business. ‘They don’t want any exemption or stay laws, $ or taxes; all such are regarded by fraud on the rights of a legitimate ‘They ean take care of themselves, and are ready to meet competition in the collection | of debts as they are to meet competition in the sale of goods, wares, and merchandise—by the employment of superior skill and capital. They have a personal interest in the repeal of the act, very much (he same as the New York importer has for the repealof the tariff on foreign im- ports. ‘There are others who have objections to the workings of the bankrupt law, which arise out of their ignorance of its real character and merits. Of these we have neither tim space to speak at present, or to answer u! tions which they urge. One thing is very important in this connec- tion, that whatever Congress does on this sub- ject in the present aspect of the matter should be done upon full deliberation and discussion.
