_EVENING STAR. Largest Circulation in the Distia Beading Matter on Every Page. WASHINGTON OITY: SATURDAY......... November 9, 1878. Libel-Sait Abuses. Onr readers will remember the late attempt ‘fone William Prince, alded by a lawyer who undertook the case on speculation, to bleed ‘Tue STAR newspaper through a libel suit, in which the rather handsome sum of $10,000 was claimed. To the astonishment of cy this speculati partnership of lawyer an: client found s jury sufficiently stultified ‘2 bring in 4 verdict of $3,000 damages. Asset forth at the time, there wasin the publication of which Prince complained none of the ele- ments going to make up a libel. It was shown that this item found its way into the paper through the ordinary local channel, m perfect good fx no person connected with its publication having any shadow of animus against Mr. Prince. It was shown that, so far from there being any malice in the matter, the relations between the Stax company and Prince were of anenttrely friend- ly nature, he being anu advertiser in the paper, and they having no wish or motive to do him harm. Prince, himself, testified that he did not believe Tae Star intended to injure him by the publication, nor was he able to proye that he bad been injured to the extent of a penny by it. Neither could it be shown that he had been injured in reputation in the slightest degree by the publication, or that it was caleulated to bring upon him any obloquy or disgrace. That the jury in view of these facts should bring in a verdict of $5,000 in his favor was considered as- tounding. Judge MacArthur ip granting anew trial said “it was difficult to see on what the jury had based 9 verdict of this amount when he had excluded special damages. He could not say that they had acted partially, but be was astonished on its rendition. He could understand, had the paper been in the habit of publishing Mbellous mat- ters, had such a verdict been rendered. But it was not. Since he had been in the city he had Observed the course and conduct of the papers Of the District, and he had found the defendant | (Tae STAR) to be the most decorous of the jour- nals published here; and it certainly was not his intention, in instructing the jury, t single it owt or such a verdict.” ‘The astonishment of the judge who sat in the case, and of the entire commanity, at this out- rageous verdict, was shared by the country, and ‘was commented upon everywhere by the preas. We wish it success in the end.” The libel suit of The American to which reference is made above was based upon a pub. Neation by Thr American regarding the course of a man named Snyder, who was a newsdealer on the Baltimore train, at the time of the riot at the President-street depot in 1868, when the passengers on thelr way to Philadelphia (on the day before the Pennsylvania election) were @ragged from the cars and brutally beaten. The ptaintii@, Snyder, alleged that he had lost his situation through the publication, and asked $10,000 damages. Jadge Dobbin in this case did hot sustain the antiquated doctrine that a news- paper is to be held responsible in all eases for the truth of the publication. He held that if the conductors of the journal believe their state- ment to be true, and act from the ordinary in- tent of a journalist to inform the public and reform abuses, even though the statement prove to be untrue, and the matter charged is a crime, still the innocent must suffer, as the journalists areas truly innocent as the person against whom the erroneous crime is charged. In the case of the American, be ruled that if the statement was believed to be true, and was published for the public good, it was a privileged commanica- tion, and the plaintiff could not recover. The jury, despite this charge, rendered a verdict for #2% damages, and the case was appealed. On the second trial this verdict was reversed, and a verdict rend*red for the defendants. Bvt to return to our Prince-Carrington libel Suit. It was to have been supposed, in view of the rebuke administered by the judge, and by the public upon this verdict, that the parties to this prosecution would not nave the face to appear again in court; but it seems their thirst for speculative damages is toe keen to be thas subdued. They have again brought up their “case” and increased the amount of damages ‘claimed to the modest sum of 20,000 ! And this, in view of Prince's admission that he felt him- self so little damaged that he had no idea of prosecuting the suit antil his enterprising eoun- sel volunteered to take it up on speculation, charging him nothing unless he gained the case. ‘The reason why the speculative partnership now put up their demands to the enormous sam of $20,000 is evident. We are afraid, from the teuor of its article, that the Commercial supposes there is considerable tippling in Washington on Sunday, whereas we suppose our Sundays are without question the most decorous and sober known to any city of the size in the country.
