EVENING STAR. _ (ROSRY & BOYES ......Kditor. | WASHINGTON CITY: FRIDAY February 23, 1872. PExsecctioy oy Newserarees.—The Wash- ington STAR, baving published an item of news that was assumed to injuriously reflect upon a certain citizen of Washingtom, a libel suit was brought and the jury have awarded a verdict of three thensand dollars demages. The case ap- Pears to bave been that the — it bad no intention te harm the plaintiff, 1 tion was made thro: mation, and = publica- gh the ordinary channels of jon and apolozy were d when the facts in question ‘otwiths*anding that there was no printing of the item, and that ubsequently did full justice to the the jury found this unjast verdict It is clearly a most fingrant outrage, and the only explanation possible is that the jury had bot an addlepated conception of the privileges and immunitiesof newspapers. It isnothing new that trisls in our courts should farnish instances ©! how densely stapid an American jury can be, but in the line of civil suits we know of nothing more unwarrantable than this verdict. Tae Stak is goimg through somewhat the same cx- ethat The American has had, but if it I fight the battle through as we did it will at last find twelve men who don’t believe tus newspapers should be made the prey of leg thysters. We wish it success in the end.—Balti« wore American. ‘The libel suit of the Am-rican’s, to which ref- erence is made aboye, was based upon a publi- cation by the American regarding the course of @ man named Snyder, who was a newsdealer on the Baltimore train at the time of the riot at | the President street depot in 1863, when the pas- sengerson their way to Philadelphia (on the day before the Pennsylvania election) were dragged from the carsand brutally beaten. The plaintiff, Snyder, alleged that he had lost his situation through the publication, and asked 86.000 dam- ages. Judge Dobbin in thiscase, did not sustain the antiquated doctrine that anewspaper is to be held responsible in all cases for the trath of ihe publication. He held that if the conductors of the journal believe their statement to be true, and act from the ordinary intent of a journalist to inform the public and reform abuses, even though the statement prove t8 be untrue, and the matter charged is a crime, still the innocent animus in th must suffer, as the journalists are as truly innocent as the person against | whom the erroneous .crime is charged. | In the case of the American he ruled that if the statement was believed to be true and was pub- lished for the public good, it was a privileged | communication, and the plaintiff coald not re- cover. The jury, despite this charge, rendered a verdict for $250 damages, and the case was appealed. (n the second trial this verdict was reversed, and a verdict rendered for the defend- ants. The American deserves the thanks of the newspaper press of the country tor taking this | firm stand in defence of their rights; and all the more because, the damages being nominal, it would have saved money and annoyance by quietly accepting the first verdict. ‘There is a well founded complaint among | business men in this Distriet that sight drafts | are often presented to them in the afternoon, or it may be that the draft is merely presented at their place of business during their absence, and if not agtepted before 3 o’clock p. m. of the | same day is protested. This is all wrong. The drawee may require some hours to ascertain ether the draft is one which he should honor. | is not in bis place of business when it if presented it should be left for him to examine, Without compelling him—sometimes at great in- | convenience—to go the bank. In New York | that course is pursued, and should be here. The | New York Jowrnal of Commerce, excellent au- | thority on all such questions, says: “The drawee of a draft has twenty-four hours atter its presentation, during which to consider | whether or not he will accept it. This ig his legal privilege, and he may insist thatthe draft | ©ran exact copy of it shall be left with him | during that period. Few merchants, however, avail themselves of this extreme limitation. A | draft, either at sight or on time, ought to be presented before one o'clock to secure attention the same day. If presented after banking hours, pecially upon Saturday afternoon, it could not legally be protested for non-acceptance before three o'clock on Monday, unless the drawee in terms refused to acceptit.” —_— A democratic paper in New York moralizing he day we celebrated” yesterday sadly “If Washington were here to-day he | would not find himself at home in ‘the strong .central government’ now absorbing all powerin the land te which he bequeathed the priceless blessings of liberty.” This is the silliest sort of twaddle. “If Washington were here to-day,” | he “might not find himself at home;” but it would be because the nation he helped to found bas outgrown in population, wealth, civilization Bnd all the elements of prosperity and progress the wishes and hopes, even the wildest imagin. ings/of himself ana bis cotemporaries. These ‘croakings about ruin from a‘‘strong central gov. ernment” would be familiar to his ears, for the same note has been sounded through all the ad- ministrations from his to Grant’s. There are always some political dyspeptics who insist that the country is going, in the language of Manti- iini, to the “‘demnition bow-wows,” and yet it Seevery year more prosperous. Its future may be safely left to the care of those who have guarled its past—the people—and Washington, af be were around, would no doubt be well satis. fied with the progress so far made. Some of the Washington correspondents are engaged in the disreputable work of telegraph- ing trom this city unfounded statements as to the prevalence ef small-pox and scarlet fever here. their sole object being to bring discredit on the Board of Public Works by ebarging that the improvements m progress have had a dele- terious effect on the health of the community. As an offset to these unfair and prejudiced pub- ications, we copy the followiag paragraph from & dispatch to the N.Y. Journal of Commerce, (democratic,) from their careful aud conscien- tious correspondent “W. P. ©." “So far, this city has been wonderfully clear of cases of small-pox. The Board of Health have been vigorous in instituting safeguards, and the result is highly gratifying” Two of most prominent physicians say neither of th: has had a case of small-pox or varioloid in his list of patients this winter. They say, in lower Portions of the city, among the neglected class of colored ple, some few cases h: occurred, but there is less of tt now than there has been, and that the wide streets and street im- wements of Washin; fluence against the die ase as an epidemic.” The action of the republican state central Committee of Pennsylvania, conferring on the state convention, which meets at Harrisburg on the 10th of April, the right to select district dele- gates to the republican national convention, is denounced by seme of the county committees as @n undue assumption of authority, and they claim the right to elect the delegates and have called primary meetings for that Purpose. Col. Forney says, in the Philadelphia Press, that there is a very easy way out of the difficulty, and ‘Suggests, as the Pennsylvania republicans “are tor Gen. Grant's renomination,” that «(wherever the peopleelect their delegates to the national convention, let the state convention them, and wherever dogma of the state central committee. state convention accept them. = — ee —__ IxpiaN CrTizExswiP—It is understood ‘the House Committee of Indian Affairs ame incline to the opmion that Indians may citizens of the United States without .wp their tribal relations. ‘This will enable them te continue to hold their lands in common, as now, and will have am important bearing on the action of Congress on the Oklahoma bill. ‘Tax Werrcy sr “ " ‘AR, now ready, centains the Proceedings of Congress; the fuss about the Washington Treaty; the District government investigation; the row about the sale of arms to Sran’s libel * Ropaclcas® £5; breeding or Proceedings | Mr. Davis | Vice President on the fi | Ewing. of Obio, 22. | city. TRE Can-H0ox Mveperer Ke-senrenc William Foster, convicted of the murder of Mr. Putnam, was re-sentenced this morning, and the day of hisexecution is fixed for the 22d of March. The general term of the supreme court has patiently heard the case presented by his counsel, but the appeal has been overruled, and the murderer stands under the sentence of the law, to expiate a crime which was with. Se Saree em except that of drunkenness. The delay which has beea inter- posed between the first conviction bj nd the execution of the penalty was ps a eeeaeeteie eer en of this case, while it cannot be ‘conked that slow course of justice has led the ruffianly ele. ment to yegpea extreme with con- tempt.
