< Rosey 5. NOYES . Largest Circulation in the District Reading Matter on Every Page. WASHINGTON CITY: THURSDAY February 2, 1873. Libel-Suit Abuses. ‘sume there was not a lawyer present in room yesterday who was not surprised by the verdict g im the suit of William Prince against the Star Newspaper Company; and this surprise was fully shared by the community, to know by assurances from all quarters, There was in the publication of which Prince com- plained nene of the elements going to make up alibel. It was shown that this item found its ay into ihe paper through the ordimary local channel, in perfect good faith, ne person con- nected with its publication having any shadow of animus Mr. Prince. It was shown that the editor of Tux Star on having his attention called to the publication by Mr. Prince at once wrote out and published a correction worded in «xact accordance with what he under- stood to be the plaintiff's wishes. It was shown that so far from there being any malice in the matter that the relations between the Stam company and Prince were of an en- tirely friendly nature, he being an advertiser in the paper and they having no wish or motive to do bim harm. Prince, himself, testified that he did not believe the Stan intended to injure him by the publication. Nor was he able to prove that be had been injured to the extent of a penny by it. + could it be shown that he had been in reputation im the slightest degree by the publication, or that t was caleu- lated to bring upon bim any obloquy or die | grace. That the jury, =< in @ verdict of $5,000 in his favor is Really if this sort of verdict és to be the rule, the business of newspaper publishing, already | onerons enough, will be about the most harass- ing and undesirable one going. Every newspa- per of any responsibility must count upon being made the prey of a set of harpies, searching newspaper columns assiduously for some item which can be twisted by legal ingenuity into a libel. The antiquated and narrow-minded libel Jaw, devised at a time when the idea of a tree, active, and energetic press had never beencon- ceived, affords singular facflities for the leeches who seek to bleed newspapers having any biood inthem. For a few dollars a libel suit can be and held over th ds of publishers compromise to save annoyance; and to invite there are always pienty of speculative lawye Teady to prosecute such caseson the chance ot getting their fees out of the damages. It is » to publish an item of news ot Inot atford some opening for ing gentlemen to ferret out a claim tor damages; and a question for the Press of the country to consider whether it is not about time, having fought the battles of every- body against oppression and abuses, it f the libel law, under whose techni- it is possible for a jury to give such a as that of yesterday. The issue whether a certain sum of money shall or s not be >, but whether newspa- pers hereafter to be published shall have any- thing «m or not. If this verdict is to be med, then every man who may assert that bis name has been unfavorably mentioned in the current news of the day, bas the journals of the country by the throat. ‘This is a question in which the public as well as newspaper publish- ers are concer it shall be fairly met and fully understood. -see- While some of our politicians here are clam- orous tor a change of the organic law which shall allow the voters to select numerous offi- cers of the District government, appointed un- | der the present system by the President of the United States or the Governor, other commu- nities are agitating for a change in the other direction. It is stated that during the siege of Paris one M. Dupuy de Lome received from the government of National Defense an offer of twenty thousand dollars tor &@ balloon which he undertook to furnish, but it Was not fintshed prior to the capitulation of Pa- ris. About three weeks ago, when all was com- plete, he made an ascent with thirteen men, and the result seems to have satistactorily demon- | strated the perfection of his method of gu:ding. | The balloon is said to have obeyed the helm with the utmost alacrity, and to have progressed Teadily in the teeth of the wind. s2e-- George Alfred Townsend furnishes the lead- ‘mg article im Scribner's Monthiy,—a handsomely illustrated paper on “The Chesapeake Pen- insula.” The subject isone on which Mr. Town. send is literally at home, and the sketch, like everything from his pen, is sprightly and in- teresting.
