To understand the case a brief review of its bistmy may be necessary. When Roger C- ‘Tichborne left England for South America, his uncle, Sir James Doughty, was in possession of the Tichtorne estates. He, dying childless, the tle and estates fell to the claimant's father, who, aleo dying, his eldest .om, Rozer C., would inherit had he survived. As it was believed that Roger perished in 1:53 in the shipwreck of the ship Beila, im which he unquestionably sailed from Kio t>) New York, his younger brother, Altred succeeded, and he, dying at the age of twenty-six years, lett an infant who, had not the claimant appeared, would unobstructedly ‘on arriving at legal age, have assumed tho title and proprietorship of the cstatcs, producing $130,000 income. The theory now is that the claimant’s father had an illegitimat: child by h‘s cook, Mary Orton; sister of old George Orton, who the defense have held was the claimant's father, and by whom the claimant, unc - the name of Arthur Ort m, was brought up. The boy was ignorant of his trae , and aster many sitange vicissitudes settled in Australia, where he was found in 1866, under the name of Tom Castro, pursuing the calling of his putative father, a butcher's. Old Lady Tichborne was 0° an erraie and un.ound mind, and though thirteen years had tcar<pired without tidings from her long-lort .on, she was monomaniacal en the subject, and not despairing of his being alive, continued to advertise and offer rewar’s.
