Suales; exceptions overruled and judgm-nt on award. CouRT IN GargRaL Tenw.—Judge Cartter sirearset this court to the 4th of February to- ye PoLice Court To-Dar, Judge Snell.—H. Smith and J. W. Knott, a street car conductgr and driver, were arraigued on the charge of cruelty to animals, Mr. Gatchell testified that he and Dr. Corbin were together at the corner of Pennsylvania avenue and Lith street, when the car passed along crowded to its utmost ca- acity; the horses were exhausted by the heavy lease stopped; the driver was urging them up, and the horses could be heard to pant and breathe balf @ square off. The track was cov- ered with snow, and the wheels were completely clogged up with it. A.H.Shalluck, a passen- ger, testified that the car was overloaded, and when it stopped two-thirds of the passengers got off, and he afterwards counted these who remained, and there were twenty-seven left. Officer Crump testified that he saw the car stop, and in afew minutes Mr. Gatchell called upon him to arrest the driver aud conductor; the hos ses were laboring very hard, and the driver was ipo pe beer up. The ordinance levying taxes for the year 1871 was then taken up and di at length by Mesers. Collins, Pickrell and Dunlop, the two latter in opposition to the ordinance. . Collins stated during the discussion that the tar at 30 cents would realize about £18,000 for street im- provements, and there was $5,000 for the samo purpose in the clerk's estimate to be paid out of the general fund, making a total of $23.00, There would be a deficiency of $15,000 on West street to meet, which would leave only $3,000 to Pay money already borrowed of the bank for strect improvements and to keep the streets in repair, of ot which needed it very badly. Mr. Piekre!l moved to strike out the 90 cents for improvement of streets; which was lost by a tie vote— Mewrs. Casilear, Dunlop, Fuller, Grimes and Pickrell voting aye, and Messrs. Beall, Berry, Collins, Curtis and Marbary voting nay. Bir. Pickrell moved to fix the amount of street tax at 10 cents; which was jost, only Messrs. Uasilear, Danlop and Pickrell favoring it. Mr. Marbury moved to fix it at 25 cents; lost by a tie vote—Messrs. Beall, Berry, Collins. Curtis ard Marbury y for it. A motion by Mr. Dunlop to make it 15 cents was lost—7 to 3. Mr. Fuller moved to make it 20 cents, and it was adopted—Messrs. Casilear, Curtis and Grimes only voting in the negative. Mr. Casileat said he was opposed to the bill because his property was not enhanced in value by the improvement of Washington street, and other projected improvements. Mr. Pickrell moved to reduce the general tax from 70 to 50 cents; lost by a tie vote. Mr. Dunlop said that on s0 important a matter, when a reduction of tax is lost by a tie vote, it ought not to be insiated on. Mr. Collins thought it was no fault of those who favored the bill, as they were as conscientious and disinterested as those opposed to them. The members of the committee on ways and means had no persona! ends to serve. They looked only to what they believed to be the best interests of the town, and were well aware that it was a very unpopular thing to report a tax bill to raise enough money to keep the credit of the corporation as good as it now is, and carry out any improvements.
