Gen. Botier first raised the objection to the appearance of Mr. RK. M. Corwine fer the retary of the ipteert Hyer had filed the motion to dismiss the appeal in the court below; on the ground that he had no authority to offer and make such motion under the recent act of Con- [soy forbidding heads of departments employ- ng epecia! counsel, and allowing the Attorney General to lo so only in certain cares.
