The amendment strikes out the first section, which ¢ legal rate of interest im the District to be seven per centum per annum, and inserts tg the second section that the rate of interest sball be ix cents on the hundred by the year om money due by express contract, uuless a different rate be expressed in writing: on all money after the same becomes da, where there is BO contract fixing the rate of interest; oa judgment and decrees for the payment of mo- ney. where no other rate is expressed; on mo- ney lent without s contract fixing the rate of interest; OM money received to ihe use of another and retained beyond a reasonable time without the owner's con:ent, expressed or im- plied, &e. It also enacts that parties may agree, im writing, forthe payment of interest ot exceeding the rate of erght cents on the hun- dred by the year. It also repeals the act where he same may be inconsistent with the present one, eptitied “An act against excessive usury,” passed by the Assembiy of Maryland 3d Octo- ber, 1704. It is probably desirable that a rate of inter- estehall be established as the legal one where there is no contract made fixing the rate; but it strikes us tbat the committee in specifying eight per cent as the maximum of legal in- terest are still clinging to the old exploded theory that legal enactments prescribing the price of money is of any advantage to the pur- chaser. In fact, as sll experience shows, sach jaws merely serve to frighten the timid money- owner, and throw the borrower into the hands of the unscrupulous knder. who skins him at the rate of from forty to sixty per cemt. Mr. Sterman,.—rhe Senator from West Vir- ginia was not in the Chamber a while ago when, by direction of the select committee, I moved to strike out two of the raiiruads con tained in this bill, with a view to confine it to the one railroad from Washtozton to New York As & matter of course, the Senate having adopted that amendment, the same reason ought to induce the Senate to refuse to put this n-w Failroad on this bill. J am in favor of the road now suggested, aud 1 know a good deal about the Chesapeake and Onio railroad, and can endorse much that the Senator bas satd, but [ hope it wall not be put on this bill, The bill 1s, now confined simply to one road, in order that the question of the power of Congress may be decided. and that the road of most pressing im- portance may be left alone to stand upon its own merits. J trust, theretore, that the Seun- tor will not press his amendment. Mr. Pomeroy said the pill had now been stripped of all its valuable featares. We did not want any route to New York. We were well enough accommodated now in getting to New York. Qontinuing hesaid:—In my opin- ion this amendment is of vastly more impor- tance tban the bill itself. I ‘no not want to die tor what is not worth killing me for. 1 have sowe doubts about the exercise of this power, but if I have got to help to pass this bill and vote for it simpiy to facilitate communication between bere and New York, and cut off communica- tion from those sections of the couatry where We need something, it is not .worth the paper on which it is written. J insist upon baving a vete on the amend- ment of the Senator from West Virginia. I desire to vote upon it and to test the sense of the Senate mpon it. We propose, if possible, uot cnly to help this city of Washiugton, bat to copnect it with what ts soon to be the great center of population on this continent—the val- Jey of the Micsissippi and Missouri and our possessions beyond. I have not listened to the clamor about removing the capital West; Ido | not believe a word in it; but 1 want the West connected with the capital, vecause this ought to beacity of towering magnificence; itsshadow ought to extend over the land. Instead of open- ing communications where we have already got them, let us open some where we need them. Mr. Sherman.—l only desire to say a word in reply to the Senator from Kansas. He bas a very good way of showing his friendship to this till—by refusing to take it up! Now, let me say to the Senator from Kansas that if he is really desirous of passing bills to charter ratl- roads to Washington he must take them one at a time. Mr. Pomeroy,—Let us nave oue for a road tbat we need and not one that we do not need. Mr, Sherman.—l am in favor of all these brite: but Senators seriously object to the idea of putting three or four incorporations in one bill; and several Senators, who were perfectly willing to vote for either separately as a matter of the order of business utterly objected to voting foro many inone bill. Webadesough of these combinations of various railroa/ls i the Pacific railroad bill to satisty me. 1 gen- erally object to having more thin one object in a bill. The Senator may be certain that if this bill is passed another bill will be passed for Toads making connection nortaward, north- westward, and scuth westward, so that all these various railrosds may be accommodated. As 8 maiter of course I am in favor of the propo- sition of the Senator trom West Virginia; but I do not think it ought 'o be added to this bill. Let each of there bills stand on its own merits. If the Senator sys we have communication enough with New York, let him vote azainst the bill, as he would have done at any rate. 1 aid not expect he would yote for it, as a matter of course. There is no railroad competition between Washingion and New York. There is vital necessity for competition. If the S+n- ator does not wish another road to New York, as a matter of course he will yote against th> bill. 1 will vote for the proposition of the Sen- ator from West Virginia ae a separate measure; I will vote for, and hope yet to see, a line con- s:ructed on the only natural route from Wash- ington Westward; that is, to the Point of Rocks, aud thence by way ot Cumberland to Pitts- burg. One of the last sections in this bill pro- vided for line cf railroad to reach the Cnesa- peakeand Obio Railroad, the very ope now suggested by the honorable Senator from West Virgivia. If the Senate shonid choose to put these bills together I am perfectly willing to vote for them all together, although I think, as & matter of legislative policy. it would be bet- ter to pass them on+ at atime.
