Yesterday afternoon at three o'clock, the case of WH. There were present quite a number of speciators, embracing some of those charged conspiracy, and several members of the . The warrant in tais case is based om an | atdayit of Mary E. McGee, charging Warden | Heustis with baying, im August Inst, had car- nal connection with er. ir. M. Wilson, W. A. Cook and Mr. row! for the prosecution, and Mr. RUT. Merrick and James E. Williams for the defence. ‘Mr. Merrick moved for the disuharge ot the Accused, stating that the warrant charges that complaint had been made by one Mary E. M. To promise to procure her release was nut connected with hic Guties Hus duty was to keep ber locked up Hesubmitted there was no offence charged, and would move the discharge of the accused, He was convinced that Mr, H. was innocent of what was charged in the affidavit, and that the athdavit was a fabrication, con‘aining not one | word of rato. ‘Mr. Wilson replied thatit was unnecessary that the warrant should contain a. specitic | charge, but it was issued to secure the appear. ance of the party, and the magistrate: ‘att hearing the evidence, could then determine Whether there was sufficient ciuse to bold tue party. These uilidavits were not. suct as Should be laughed out of court. The ailldavit charges him with taking advantage of a p oer, placed im his custody by the law, and prosiituting her to his uses—an offence of srave aracter, and if such an offence 1s not punish. le there is bo justice in law. Mr. Merrick ‘said, in reply, that however Wrong and immoral such things were, they Were not criminal, and the justice bad hothing te do with such a case, Justice Walter decided that the magistra‘e’s Was toexamine the cases brougit befor hii, and certam it was that if no other off was charged inthe affidavit, assault aud bat. tery was charged, nnd be directed the counsel (0 proceed, ry E.
