He then spoke of the character of Mr. Seymour, who, he said, was sending troops to Gettys- burg when Horace Greeley was implorioz Yer. Lincoln to recognize the Southern confederacy. As to the doctrine promulgated by General Biair, it was entirely correct. The Southern States were entitled to their rights as States, and if Virginia under the recoustruction act= should putan electoral ticket in the fleld in this camp.itn and carry it as they would for Seymour and Bisir, and the Radicals should attempt to rule ont the vote, the Democracy of this country would wade throuch a sea of blood before that injustice should be done to that gallant old State. Bertram Leins, action for breach of promise of and seduc- tion was argued to the jury by Mr. Phillips for plaintif! and Fendal tor dant, The Chesapeake and Ohio Cana} Company. In the Circuit Coart, in the case of The Gom- monwealth of Virginia vs. The Chesapeake and Obio Canal Company, 8nd others, Judge Pinkney yesterday filed bis opinion. Toe case ‘was argued at the last term of the Circuit Court by General Bradley T. Joboson and J. P. Poe, Esq.. for Virginia, the Attorney General, Isaac D. Jones, and Col. Charles Marshall fer the Canal Company, Brown & Brune and George H. Witham: Esq for the bondholders, and Wm. A. and then). Price, Esqs., for the Poto- mac bondholders. The following is the opinion of Judge Pinkney: “It was objected to by the Canal Company, at the opening of the cAuse at the hearing, that the State of Maryland was a necessary party to this suit, «in order that the said company may be fully protected in apy decree that may be passed in the cause, and that the rights of ail parties may be duly regarded,’ and this objec- thon it bas also je by iis auswer, and by an exception to the jurisdiction of this court, filed in the cause, A’ prineipal object of the bill which the Commonwealthof Virginia filed as ‘one of the creditors of the Canal Company, be- ing to determine, by the decree of this court, the legal priorities of the creditors of said company, it Was, of course, necessary to make the credi- tors whose rights were to be devermined upon parties to the cause, and with that view certain persons woo were believed to hold the bonds of the canal company of the varioas ees isened by it Were made parties defend- to Tepresent and defend the interest of all unknown holders of said bonds,” as is alleged in the bill. But the canal company insists that the State of Maryland bas such a direct and material interest in the subject and object of the suit, that this court can piss no decree in the premises, which will protect the company Against its claims; and that the State not being & party to this proceeding, this court will not Procecd to decree in the cause, And it is fur- ther maintained that the S'ate cannot be made a defendant im her own Courts, without a spe- cial authority conferted by the General Assem- bly for that purpose. The tatter proposition being admitted, af the former is true, would it Bact ve tantamount to a denial of ju. says the canal company to its cre can get no decree against me unles: the @ party, and as you cannot make the : arty, you can bave no decree in the premises.’ he cases cited by the learaed counsel of company do not, in my opinion, sustain it, it cannot be maiutainea upon general principle, for the State ot here asking protection for its rights as acriditor of the canal company, And there is no principle of equity, that Lam Aware of, which will permit a debtor to set up such a defence to the claim of bis creditor. The opinion then reters to the decision of the Court of Appeals in the case of Boyd vs, The Chesapeake and Ubio Canal Company, 17, Md. 195, cited by the counsel, and continue: “And it 1s argued that the State nas such rights and interest in the object of this suits that it will be impossible to do complete justice between the parties before the court, unless the State is a party to its proceedings. Aud the case of Brady Vs. The State of Maryland, de- cided by the Court of Apprals at the October term, 1864, mot yet reported, Is relied on as showing that the State has such rights and in- terests. Independent of that decision, I do not think it would be difficult to es\ablish, that the State bas an immediate interest in the object of this suit. And were the act of 1785, chap 5% still in force, 1 should bave no hesitation in now dismissing the bill, without prejudice to the merits. Butthe act of i=20, ¢! aap. 210, ree pealed the act of 178, and as the law now stands, the State cannot be made a party defen dant in this cause by the act of the complain- ant: Hoye vs. Johnston, 2 Gill, 291. It is, then, Proper. and hallit be the decision of the courts of the State, orfny department of its government to whether a suitor in one of its courts shall have justice administered to him? Ib. 319." The opinion then quotes at some length from Judge Story's Equity Pleadings, sec. 133, A, under the title “parties to bills,” and concludes as follows: “These views of the learned anthor seem to me particularly applicable to this case. L have searched the books yery diligently, and I have been able to fiud no case precisely to the poin and the learniag of the distinguisled coun who argued the case has enaoled tem to fur- nish me with none, and i bive given the sub- ject Jong reflection. The couclusion at which T have arrived is that it is my duty to order the canse to stand over, 1m order that notice may given to the State of the pendency of this suit, by serving | upon the Governor, the Board ot Public Works | and the Attorney General a copy of the bill of complaint, aud of the order of this conrt direct- ing uctice to be given Ss aforesaid.
