SEC. 30 And be it further enacted, Thatif any distiller sbail desire to reduce the producing capacity of bis distillery, he shalf give notice of such intention im wilting to said assessor, stating the quantity of spirits which he desire: thereaiter to manuiacture or produce eve: twenty-four boars, and thereupon said sor shall proceed, at the expense of the di tiller, to reduce ard limit the producing capa- city of the distillery to the quantity stated ia said notice, by placiuz upon a sufficient nam- ber of the fermenting tubs close-titting cover which shall be seourely fastened by nails, seals, and otherwise, and in such manner gs to pr vent the use of such tubs without r-mov said covers or breaking said seals. an. adopt such otber precautions as shall be pre. scribed by the Commissioner of Internal Iev- enue to reduce tbe capacity of eaid distuller And avy person who shall break, injure, or in any manner tamper with any lock, seal, or fastening applied to any furnace, still, or iermenting tub, or other vessel, in pursuance of the provisions of this act, or who shail opea or atiempt to open any door, tub, or other vess-l which shall have been locked or sealed, or otherwise closed or fastened as herein pro- vided. or who shall use any furnace, sull, or fermenting tub, or other vessel which’ shall be su locked, sealed or fastened, shall be deemed guilty of a felony, and, on convictien. shall be fined not iess than one thousand dvilars, nor more than five thousand dollars, and impri-- oned for not less than one year, uur more thd three years. Sec: 31. And be it further enacted, That when- ever any officer shail require that the water contained in any worm tub in a distillery, at any time when the still shal! not be at work, sball be drawn off, and the tub aad worm cleansed, the water shall forthwith be drawn, eff, and the tuo and worm cleansed by the dis. tiller or his workmen accordingly; au ithe wae ter shall be kept and continued outof such ‘wort tub for the space of two hours, or until the officer has finished his examination thereof; and for any refusal or neglect to comply with the requisition of the oificerin this bebalf, or the provision in this clause contained, the dise tiller shall forfeit the sum of one thou'and dole lars,and it shall be lawful for the oificer to draw cffsuch water, or any portion of it. and tokeep the same drawn off for so longa time as be sball think necessary. SEC. 82. And be it further enacted, That it sball be Iawfel for any Tevenue officer, at all times, well by m ght as by day, toenter into any distillery, or building, or place, used for the business of distilling, or in conuectida thefe- Wath, for storage or other purposes, aud to ex- amine, gauge, measure, and take an account of every still or other vessel or utensil of any kind, and of all lew wines, and of the quantit and gravity of all masb, wort, or beer, and of all yeast, or other compositions for excitiug or producing fermentation in any mash or beer, and of all spimts and of all materials for making or distilling spirits, which shall be in any such distillery or premises, or in the pos- session of the distiller; and if any revenue o:ti- cer, or any person called by him to his id, shall be hindered, obstructed, or prevented by any distiller or by any workman, or other per- son acting for such distiller or in his employ from entering into any such distillery, or buiid- ing, or place as aforesaid; or if any such officer sbali be by the distiller, or bis workmau, or ary person in hisemploy, prevented or hi defed from, or op] |, OF obstructed, or mo- lested in the performance of nis duty under this act, in any respect, the distiller shall for- {eit the sum of one thousand dollars. And le vf further enacted, That no dis tillery nor distilling apparatus seized for any violation of law shall be released to the claim- ant or any intervening party before judgment, except im case of a distillery for which we special tax has been paid, aud which bas a registered producine capacity of one Luudred and fifty proof gulions, or more, per day, on showing by sufficient affidavits that there are legs or other live svock, not less thaa fifty bead i number, depending for their feed on the products of said distillery which would suffer injury if the business of such distillery ts stopped: Such distiliery in that case may be Telensed to the cizimani, or any other inter- vening party, at the discretion of the court, on 4 bond to be given and approved in open court with two or more sureties for the tall appraised value of all the property seized, which value shall be ascertained by three competent ap- praisers to be designated and appointed by te court. In case of the seizure of and judgment of forfeiture against any distillery used or tit for use in the prounction of distilied spirits having @ registered producing cspacity of less than one hundred and fifty gations per day, or | of any distillery for the non-payment of the | special tax, the still, stills, doubler, worm, | Worm tub, and all mash tubs and fermenting tubs shall be so destroyed as to prevent the use of the same or amy part thereof for the urpese of distilling; and the materials shall be sold as in case of other forteited property. 45.
