THE ELECTORAL COLLEGE QUESTION The joint resolution passed by the Senate yesterday, excluding trom the Electors! Col- lege votes of States lately in rebellion, which shall pot have been reorganized, provides that none of the States whose inhabitants were Istely im rebellion, and which are not now rep- Tesented in Congress, shall be entitled to repre- sentation in the Electoral College for the choice of President and Vice President of the United States; nor shall any electoral votes be re- ceived or counted from any of such States un- Jess at the time prescribed by law for the choice of electors the people of such State, pursuant to the acts of Congress mm that behalf, shail have since the 4th day of March, 1967, adopted & constitution of State government under which a State government shall bave been or- €apized and shall be in operation, and unless uch ¢lection of electors shall have been held under the authority of such constitution and government, and such State shall have also become entitled to representation in Congress Fursuant to the acts of Congress in that behalf. | The resolution will doubtless be acted upon by the House at once, inasmuch as the Pres- ident is quitegmre to veto it, and Congress is impatient to adjourn at the earliest moment at which important and needed measures can be carried over the veto. Unless a remedy is applied, we may have electors of President elected under and by vir- | tue of the Johnson Constitution, and another | set of Presidential electors elected under the Teconstruction acts of Congress, cud in pursu- ance of constitutions adopted under those acts. It will be insisted on one side that the electors chosen under the Johnsom Uonstitution are the | enly persons to be admitted into the College of Electors, and that those electors, and those only, are entitled to give the electoral votes of the State: while, om the other hand, it will be insisted by the friends ot reconstruction that those electors bave no rights, and that the elect. @rs chosem under the reconstruction acts are the proper and lawful electors. A serious complication might arise from this state of affairs; and, without regard to the poiat how either political party will be affected by ‘the result, it is certainly desirable tat the | question shall be definitely settled prior to the adjournment of Congress. pee ee ees Tue FouRrsesta AwenpMeNt.—The in- quiry of Senator Edmunds, asking the Secre- tary of State to report what States have rati- fied the Fourteenth Constitutional Amend- ment, will develop the interesting and im- portant fact that. with the ratification of the amendment by the State of South Carolina, now pending, that amendment will be 8 part of the Constitution of the United States. It Will be remembered that the last Legislatures of New Jersey and bio revoked their assent tothe amendmert, and called upon Mr. Sew- ard to return their certificates of ratification, but that officer declined to comply, taking the ground that the act was in itself an irrevocable one, and must stand or fall alone by the success or failure of the requisite number of States to raufy the same after all had passed upon it. Sut independent of the action of these two ‘States, the amendment wil) be ratified within the next week by the Legislatures of Georgia and Alabama, which will place its validity as part of the Constitation beyond all question ‘This amendment settles the matter of suffrage in the Southerm States beyond the power of the rebels to change it, even if they had con- trol of the Government.
