al THE EVENING STAR. ‘The Largest Circulation in the District, CROSBY 5S. NOYES... WASHINGTON CITY: TUESDAY... +-MAY 5, 1868, | SPREADING MATTER ON RVEBY PAGE. OUTSIDE FOR INTERESTING TELE- GRAPHIC AND OTHER MATTER. RESIGNATION OF THE BRITISH MIN- ISTRY. ‘The events anticipated in this colamn yes- terday. took place & few hours later; the Dis- raeli Ministry resigned, and Mr. Gladstone was immediately sent for by the Queen and requested to undertake the formation of a new Ministry. The failure of Disraeli is one of the most remarkable on record. With his bril- liant and diversified powers, and the fertility of his resources, it was deemed probable by scute observers that he would hold a long lease of bis laboriously attained Premiershi But his official seat is scarcely warm ere he is | thrown from it by ‘his troublesome question of , the Irish Church. By skilful maneuvering he | had carried through the enlarged suffrage bill in a shape to promise bim a long and secure hold of office, and his vexation at the introduction | of the Irish question exhibited itself in an out burst of rage against Gladstone for bringing it up. I: is reported that he sought to drown his mortification in “weak brandy and water,” and became so incoherent i. the closing part of | bis speech that the House of Commons gave | him the Diat to sit down by cries of + Divide, divide!” Disraeli now goes into opposition, And a very savage and troublesome adversary | he will prove to Mr. Gladstone, the new pre- mier. The Irish church resolves must be fol- lowed up by bill, and then will come the real difficulties of the question. That Disraeli | will improve every opportunity to unhorse his Tival there can be no doubt, and unless great sagacity is shown by the Liberals in framing a measure for the disestablishment of the Irish | chureb, he may succeed. Batemay's Oren Bovrre.—The distinctive character of Mr. Bateman’s operatic represen- tations is the perfection that has been ob- tained by leaving nothing undone either through his principal artists, his choras, his orchestra, costumers or scenery. The effect is produced by the whole, and not as is usual in operatic exhibitions by having one portion well dove and the other parts presented care- lessly. Last night the Grand Duchess of G Tolstein delighted a large and tashinable audi- ence, and M’le Tostee. with that rare skill and @handon that distinguishes her and enables her to be piquant and suggestive without coarsene: did her best: her coadjutors in the lyric art sus. taining their respective parts with abili chorus was large and effective thro The Grand Duchess will renew the public thusiasm agai this evening, and be represent- ed for the last time to-morrow evening. On Thursday “La Belle Helene” will be produced for the first time. It divides the honors with the Grand Duchess in reputation, and isa ianghable burlesque on Grand Opera, and not | more suggestive of human weakness probably than the more serious versions of the cla story on which it is based. IMPEACHMENT OF TEE PRESIDENT.—The miner,in an article on impeachment, it says, “in the fierce collis- ion of political issues, and by its issue, what- it be. certain to affect materially every interest aud feeling involved m the triumph of one side and the defeat of the other,” says «It is greatly to the credit of that body that, im nearly every instance, the majority have supported the authority of their judicia nt; and when Mr. Sumner proposed a reso- jot. that the Senate should, for the fu regard the Chief Justice as having no voice in the Court, and only, as its ministerial officer, ent toadvise and inform them on ques- Jaw, the proposal was decisively neg- If & nation be thoroughly true to the Tules of fair play, great wrong can seldom be perpetrated in its name, and never with imp nity. ‘This is, indeed, civilization: the civil zation not of mechanism, but of mind; not of | luxury, but of law.” Tue Usfaro TeacuEns.—A resolution passed the Board of Aldermen last night, pro- viding for the payment of the Teachers’ sal: Ties, now some three months due. It, bow. ever, failed in the lower Board. By the an- nouncement elsewhere, it will be seen that the ‘Teachers will hold a meeting to-morrow after- noon te devise means for securing their pay. Tyxe, Jn, New York on Sunday on the historical prece- dents of the interchange of pulpits with non Episcopal ministers. He argued that the cus- tom of prohibiting the interchange of pulpits was an innovation and caleulated not only to | deprive the Episcepal Church of the sympathy of other Protestant churches, but even to des- troy its unit Josep Mayo, Mayor of Richmond. Conclusion of Yestergar's Proceedinzs, SeNaTs.— Yesterday af Mr, Bingham "conti saying he bad to point by the astute cougael ( &s to the refusal of the brol o pega! tax under his (Mr. E. eg ce. ch argument was an —— to tl es r le, and the man wi 'o Rass here te argue etre thle ‘senate te did not touch this case atall. Mr. B. here read from the provisions of the constitution relative to the veto of bills by the President, and said that it was writien so plainly in the constitution that no mortal man can gainsay it, that every bill whieh he shall i shall become a law: every bill which shall be passed by at thirds vote over his objections shall every bi whieh he ‘not ‘withit'ten days shail be a law. There it is, that it shall be a law, and the peo) es mean what they say, and ihe President and his defenders, with thear small arms can play upon the bulwark of the constitution; they cannot ore it, But, say the counsel, an unconstitutional Law cannot be law. Granted; but the President is not the department of the government to construe this matter between the je and their represen- tatives, ‘The law must stand until repealed oF | abrogated under the provisions of the constitu- tion. | Mr. B. here read from the Constitution the spreific powers conferred upon the Presiden and beld that be was neither granted legislative or judicial powers, yet both of these powersare | claimed m the defense set np for him here to- day. He claims the power to repeal your laws a: his pleasure. ‘He (Mr. B.) used this word Fee peal with deliberation, for the power to suspend aws until such a time as he (the President) saw fit to obtain a yndicial decision was a re- peal, and nothing’ else. Shall the President | ouly exeente such laws ashe may approve t Ii Be can dispense at his own pleasure with one act of Congress, cnn he not dispense with any or all acts ? He did not Propose to waste words | m noticing what he would call the mere law- yer's work of the counsel from Massachusetts, (Mr. Curtis.) who opened the case, in saying that even if the President was guilty, as charged. of violating the iaw, that did not make | him guilty of high crimes and misdemeanors. ‘The crimes were crimes which touched the na- tion’s life. If this Senate allowed them with impunity, the Government would be annihila- ted, as he (Mr. B.) had said. He [Mr. B.] would read from a pamphlet written by the gentleman from Massachusetts r. Curtis,} in 1952, on the limitations of the Eeecactvs power, and this showed the differ- ence of opinion which a learned man might hold when he was giving his views unresery- edly and when be was acting as counsel. Mr. B. here read from the pamphlet, «that the Pres- ident has no judicial or legislative power; that although Constitutional commander of the army and navy, heisasmuch bound to obey thelawsas the humblest private under his command; he has no repealing or suspending power.” This said Mr. B. is sound law. aughter.) Not very applicable in time of re bonnes but still sound iaw. The President is manifectly guilty in manner and form, as charged in the first, second, third, eighth and eleventh articles of impeachm: d no can gainsay it, unless he conced+a this extraot inary prerogattve of construing and determ ining laws at the pleasure of the Executive. The highest writer upon the law in America has truly said in bis great commentaries that | the distinction between mala prokibita and mala in a bas long ago been exploded. He referred, of course, to Kent, and he did not see why it should not be so The gentleman went on to say that the President could not be adju: ninal under the act of Il, The act of 1795, under which he attempts in his distress to shet ter himself, says that no vacancy shall be sup- plied longer than six months. and yet in his answer be tells yeu that he indefinitely sus- pended Mr. Stanton under the Constitution, | and then in the same answer he tells you that be supplied the vacancy under the act of 1795. [Laughter] ‘The law expressly declares that no one vacancy shall be filled for a longer pe- riod than six months, yet under the theory ad- vanced by the President, he can go ou making these ad inferim appointments to the end of all time. It is a new doctrine altogether that the Con- stitution 1s exclusively in the hands of the President, and when the time comes that your Constitution is in the exclusive charge of An- drew Johnson, Gold help your Constitution the people who live under it. (Faint ap- nthe galleries.) But, say his friends, must the President not protect the Constitu: tion and the people from unconstitutional laws? No. There is no power under Heaven which can call the legislative department of this Government to acsount but the people who t them. At3:50 p. m., Mr. B. having reached another head of his argument, the court, on motion of | Senator Conness, adjourned. ‘WASHINGTON SCHUTZEN V! ss — This Association will hold its regular nthly ‘meeting at tl Schutzen Park. on EDNESDAY EVENING. ‘May 7th, at7 ovcbsck, As important business is, before ‘the Association every member Is expected to be present my 5-2t HARD HES ZE, President.
