The izth intantry band was stationed in the gallery, and during the ceremonies discoursed a choice selection of music. After prayer by Rev. George W. Samson, D. D., of Columbia Coliere, and he potpourri, “Un Ballo in Ma- chera,” by the band, the degree of M. D. was conterred upon the followmg-named graduates: M. Bruckheimer, Baden, P. The following prayers of the defendant were nie "The plaintiff cannot recover unless they yen- dered the services charged under contract ex- pressed or implied with defendant. 2d. Ifthe jury find that defendant employed Mr. Corwin alone, and he afterwards went into a copartnership, and engaged plaintiffs to aid him, and the plamtiffs rendered the services charged in pursuance of such engagement, and none other, the plaintiff cannot recover against the defendant for services so rendered. 3d. Prayer refused. 4th. If the jury believe from the evidence that the defendant employed Mr. Corwin to prose- cute bis claim before the Department, and the contract was one involving a personal trast and confidence, and was terminated by his death, and could not be assigned or transferred to another, and that defendant did not subse- quently by express agreement or by their scts and conduct recognize the firm as his attorneys, then he cannot recover. After these prayers were granted, the coun- sel argued the case to the jury THE GEORGETOWN AQu CrrmmnaL Count, Chief dustice Cartter.— ‘Yesterday, after the close of the Hon. Reverdy Jobnson’s argument in this case, Mr. Brent, for United States, resumed, and ‘argued that the case in 12 Peters, quoted by Mr. Johnson, did not determine the question now at issue. The Corporation of Georgetown in that case undertook to test the nght of the aqueduct to cross the river. He did not deny the right of Congress to authorize the building of this aqueduet, bnt denied that Congress had granted the right or power to locate it at its present position. He quoted the different acts of Congress in reference to this question, and contended that these acts, appropriating money for the purpose of locating the aqueductand for restraining wanton injury to it, were not such clear declarations of legislative sanction to this nuisance, as to be conclusive upon the judg- ment of any court or take from them their pro- per jurisdiction over this case. These were meré appropriation bills, and never intended by Congress to pass upon the question “whether the agueduct was & nuisaace or not,” and the ith June, S44, was not an enlarging act, ely one to protect the property already ed or in the course of construction, argued that the grantee must use his franchise in obstructing the navigation of a river that the least possible injury to naviga- tion will be done. He said when the legisiature did pass upon it, it would be time enough then to say it was a legal structure, He then quoted from Uhle on Nuisaners, to show how a thing not originally a nuisance might become so afterwards. Mr. Merrick argued that the question turned on the construction of the acts of Congress, and that there must be some limit to the choice of the site. and that all public improvements ought to accommodate themselves to each other; and consequently this aqueduct should be so constructed as to be the least possible injary te navigation; and it ought to go to a jury to de- cide the question To-day.—Myr. Brent resumed his argument on the decision of the Court, that he would hear arguments on the fourth connt in the indict- ment; atter which General Wells proceeded with bis argument General Wells argued that there was no of- fence en the part of the defendants, aud urged that the case be taken from the jury by the court,which should ex-officio notice it. ‘The question, the Court said, was whether, under the indictinent, this aqueduct was a nuisance, erected and maintained as such. He elaborately reviewed the whole bis- tory of the Chesapeake and Ohio Canal Company and of this Aqueduct. Con- gress baving exclusive jurisdiction of this Subject did enact that the Aqueduct should be erected, and he read from 12 Peters the decision of Justice Barbour, that the Alexandria Canal Company had a clear grant of power. He asked, will the law stop to notice criminal acts, ina slight departure from this power. He said there would have to be a flagitious departure from the grant, and only in that case can a criminal action be brought. It is said also that this structure was mislocated, and might have gone higher up the ‘river, beyond navigation. The law contemplated however, the passing of the Potomac river at the incon vemence of navigation. This was an enterprise to cross the river atany point from the termination of the canal to the head of nav- igation, and the United States comes here and asks this court to punish a corporation for doing what they have sanctioned by giving them power to do, and made it by a penal statute unlawful to do the very thing it now comes and asks this court to do. ‘The fourth count of the indictment recives that by certain alterations and additions the naviga- is obstructed, and whereby a nuisance is Greate. Tt descriver ‘no things; it is not as definite as a piece of chalk. It is defective in matter of description. How could you execute the writ on these alterations. I can imagine the Marshal going there and abating certain altera- tions, but not the right ones. It would be utterly impossible for a jury to return a verdict, or the Marshal to ‘execute under this indictment, The question might have raised in the indictment whether, of misusure, the thing may dasa nuisance. All these consider- ations bave brought me to the conclusion that the aqueduct as completed in 1837 is a legal structure, fortified by more legislative sanctions than any other corporative structure 1 know of. For I have never met with any instance where the law-making power has so a so Tepeatedly sanctioned the erection, or been a partict- ator itself in the construction of a nuisance. Phe last count is incurably defective in point of pleading; therefore it does not cover the charge of the erection of a cee. the cre- ation of alterations in the aqueduct, and ease will therefore follow the motion. The detendant’s motion was thatthe Court here now instruct the jury that no offense was le- gally charged in either of the counts of the indictment, and that therefore their verdict most be for the defendant—that isto say, a ver- dies of not guilty. The Court so instructed, d the jury so found. ‘The plaints exce fed, and the Uourt signed, sealed, and enrolled the bill of exceptions. ARRAIGNMENT FOR MURDEB. Charles O'Rourke indicted for the murder of his wife, Sarah O'Rourke, on the 16th of Janu- ary lust, by beating and kicking her, at the barracks of the 44th infantry, in which he was an enlisted man, was arraigned and plead not guilty.
