IntxReSTING Wit Case.—A will case, the facts connected with which are interesting, particularly on account of the person whose testament it is having been a well-known and pular minister of the Methodist Episcopal Shurch, was begun yesterday in the Superior Court, Hon, Judge Dobbin. ‘The will referred to is that of Rev. Jas. Sewell, which was filed in the Orphans’ Court on the sth of January, 1 According to the instrument of writing, Mr. S. bequeathed to his (second) wife, Maria Sewell. his dwelling and furniture on Biddle street, $500 in cash, and all other moneys in possession of the deceased at the time of his death. All the rest, residue, \d remainder of hi: tate—real, personal, and mixed—he also left to his wife as Jong ax she remained his widow, or, in case she did not marry agam, until’ her death, Phe property so left, excepting that first ed, over which the Widow has entire con- divided among the children of the death of Mrs. Newell, consisting | of Mary Rebecca Harbeck, James G. Sewell, | Serena H. Griffin, and the adopted child of the deceased, Margaret Maria Sewell, Halsey. und his grandson, Jame- 8. Tuthell, ‘The children | of Mr. Sewell not being satisfied with the man- | ner in which the property was bequeathed, they, through their counsel, Messrs. C. B. and F.C. Shingluff, sued out a caveat to the will in the Orphan's Court, and the points raised in | the caveat were sent wp to the Superior Court for trial. Five issues are presented in this case—in the first of which it is contended that at the time the will wis signed the deceased was not of a ound and disposing mind, and not capable of Xecuting a valid deed or contract; and iu the others undue influence is charged against the | wife of the deceased, which undue influence | the deceased m his then situation of body and mind was incapable of resisting. The case is bronght in the name of the children of Mr. Sewell against William B, Hill, executor of the deceased. ‘Lhe Messrs, Slingluil appeared as counsel for the cavento . Willian Daniel and John C. King for the caveater, The caveators were rxainined betore the jury yess terday, the rvidence being d igned to sub- Stantinie the charge of undue influence, which occupied the court up to the time of adjourn- ment. The case will be resuined this morning, and will probably occupy the court nearly all of the present w Balt. Sun, 26th.
