Trial for Murder. THIRD DAY. After curreport of the trial of Henry Johnson, iodicted for the murder of Thomas ‘Smoot mo the 20th of June last, in the Criminal Court, Jadge Fisher. closed, yesterday, the ( Foss-examination of Ahol: ‘was con- ued, as follows : Witness, on making inquiries about the re- t th rs. Jones, sworn.— Witness is @ member of the bar of this District; knows Johnson and wifv: has had many interviews with them on business; thinks all tat he Knows of the reia- tious of’ Jobuson and his wife came to his knowledge in the course of professional busi- nese Mr. Davidge objected that knowledge of that character could not be given in evidence, and after some argument the Court remarked that wt did not think anything could be gained by tins course of examimation. It would be im- possible to prove malice by # deed of trust. ‘The Court adjourned to this moraing, and the jurors accompanied by Bailiffs King and ndler were taken 9 the Seaton House, where quarters are provided for them. FOURTH DAY. At 10 o’clock this morning the jury were bronght into Court from the Seaton House, and the District Att said that they would con- clude the ease at this point. ‘The only atdi- tional evidence they wished to offer was what they expected from Mr. Jones. Dir. Davidge said that the defence offered no objection as to the deeds. r, Wilson offered in evidence two deeds of ust exeented by Henry Johuson and Cathe- rine Johnson, dated December 12th, (906, one to FLW. J. as trustee, for the sole and sepa- rate use of Henry Jobnson, and the other to Mx. Jones, as trustee for Catherine Johnson, Mr. Davidge opened the case for the defence, saying that his duties were light, Tue turning pomt was whether there was cooling time. No one pretended that the prisoner killed Sinoot on suspicion only, but he canght the sto gether. Mr. D. read from the Sickles case, and said the jary should inquire into the condition of the prisoner's mind at the time—the effect such information as he had received would bave ona man. Manslaughter may be commit- ted by @ ian in a transport of passion; but in @ case like thisa mamis not responsible tor his act. They intended to show that the accused bad reason to fear great bodily harm from Smoet, and if they did prove it, the Court wonld instruct them to find a verdict of not guilty. He went there, not dreaming that he would find them as he nad found them. ‘They proposed to prove that Smoot was the larger man; that he went armed; that the ac- cused and lis wife were affectionate; that they slept together the night before the homicide, and that on that day he was in the court-house, paid his taxes, went to the house on Sixth street to inquire if what he had heard was true, And if so, to give the wife over to the seducer. Smoot was here penniless in 1864, and th» ac- ensed took him in. After picturmg the parties in the room,he referred to the wounds, and con- tended that from their position they showed the deceased was shot when out of bed, and that the wound over the eye was the second o1 He read from Wharton’s ist American Crimi- inal, 4, see. 1025 and note to 1027, and said that il they believed that Johuson had serious ground to apprehend that Smoot intended to do him bodily harm, that he grappled with him, then there was an end of the case. Smoot pursued the woman for no other reason than the love of money. If there was a time when a man appre- hended bodily harm, it was when he had foaud his enemy had seduced his wife, and had her in a house of the character he would prove this to have been; for men on such errands always goarmed. Witness believes he was summoned on both sides, Mason Shipman sworn.—W itness lives in Fuir- fax, and has known the prisoner ten or twelve years; saw the prisoner at his homse on the ‘evening before the homicide. Jha Johnson *worn.—Witness is the son of the prisoner, and recollects the killing of Mr. Smoot; was living at bis father’s house; his father and mother were xt home on the night before, and slept together. John West «worn.—Witness owns the house in whieh the bornicide took place: rented it to a man named Rutherford, who furnished the hons¢ and lived in it3 or 34% months.
