AN IMPORTANT CASE Une of the most important causes likely to be treed at its present term, and which will attract attention as well on account of the legal prin- ciples as the amount of money involved, will come up before the Supreme Court of the United States to-morrow, if the case in hand can be disposed of in tim: We allude to the matter familiarly designated by those cognizant of it as the “Elgee Case:” one ofa numerous class growing ont of operations under the exptured and abandoned property Sets during the late rebellion. Without going into technical details, the main facts of the case, as we understand them, may be briefly stated as follows During hostilities in the Missixs1ppi Valley. in 1563, party acting under Government au- thority, and convoyed by a gunboat, ascended one of the bayous or minor affluents of the Mis- ~i-ippi, on the eastern bank, and removed from a plantation lying thereon, and belonging toone John K. Elgre,—since decensed, but at that time domiciled in the western part of Lou- isiana,—between five and six hundred bales of cotton, on the ground that the same was aban- dened or confiscable property. The cotton, after considerable delay and some danerous Victesitudes, reached St. Louis, consizned to a Governmentagent. Qn arrival there legal pr ceedings for its recovery were instituted on be- ve credings,—which were somewhat complicated | in their character, and th: ned fora time to litary authorities, and to avoid loss from de- Preciation in price, it was agreed between both | Pprties in interest that the cotton should be | sold and the proceeds invested in ten-forty bonds, to be held to abide the final issue of the suit. The fight then went on in one of the St. Louis courts, subsequently in the Cirenit Court | ofthe United States, and it now comes up on appeal to the Supreme Court, on some prelimi- BSTY questions. we believe, but the decision of which will have an important bearing on the ultimate disposition of the case. In the meantime, some half a dozen diverse clsimants to the same property have appeared, all claiming title or rights through or under | Elgee, and efforts will be made by them, it is wnderstood, to be recognized in the case, but Whether they can gain any status in it, or whether any decision as to their claim will be given, as the case now stands, is not clear. The amount of money involved is about £400,000, and, as may be expected from its mag- nitude, eminent counsel are engaged on both sides. The Government will be represented by Senator Drake and Judge Hughes, while the claimant’s interest will be cared for by Glover & Shepley, of St. Louis. and J. M. Carlisle, E-q., of this city. The other parties in interest have also employed counsel no less di-tin- guished and able. The case will occupy, it is thought, several days, and will doubtles« attract, a8 stated above, considerable attention from both the bar and the public at I: course ideas differ as to the ultimate result of tbe case, though we believe the weight of opinion is to the effect that the Goverument Will come out victorious, prea cat atic Mizrtary History or Gexerat Granxt.— From the publishers, D.
