Whether sider npon there was a warranty that this article should be pure, dry No. 2 Peruvian guano, and the de- fendant’s presence in Philadelphia, and his ex- amination of the article, is no waver of the warranty; 2d. That if any deceit or misrepre- sentation, intended to misiead and did mislead, it hus the same effect as a warranty. The Court is of the opinion that this was a contract tofur- nish No. 2 Peruvian guano, and if not fur- nished, it is a failure of contract on the part of the plaintiff, and be cannot recover. Every man is bound, when he agrees to furnish an article, he must furnish the article of the kind he contracts for, and the No. 1 Pernyian guano is not No. 2, and this contract is specially de- clared on and set forth, and bound to take it back, and if they are in the way and he sell, he must pay not w! be got for them, but what was the market value of the goods at the time. There is evidence showing that the guano smelt unusual strong, and that would have been a good test, but there are tricks in this trade as well as others, There is no very strong evidence to show that the plaintiff in this case ‘was guilty of adulteration, but some other man from whom he purchased. It is for you to judge whether the plaintiff had any knowledge of this fact. Ifso he isto be charged with that knowledge: if he was guiltless of any fraud even the lo=s necessarily fell upon him, for he induced defendant to purchase and ‘he has bronght this suit, and he mnst show a clear right to recover: and if he is innocent then the burden must remein where it is, for of two equally innocent parties the law allows the burden to rest where it finds it, and will not shift the responsibility to some one else. There are several counts in this declaration, and al- though this article was not No2 guano, if any value, at all the plaintiff is entitled to recover that value, but it must be gnano. Defendant is entitled to set off as to value of the freight and the analysis of the article, Mr. Davidge reserved an exception to the re- fusal of the Court to grant the prayers of the plaintiff, Mr. Harris, for defendant, alsp did the same to be safe if the case should goto a Ingher tribunal. ; ‘The Court then said he wonld grant all the prayers subject to the qualifications in his in. structions. ‘The argument to the jury was then postponed until Monday, and the Court adjourned. Selby, a colored man was arraigned before Justice Clark, of the Sixth precinct, this morning, to answer the charge of stealing one black cloth cloak, a table cloth, far cape, plaid silk skirt, grey woollen shawl, woollen cloak, and other wearing apparel, the property of Elta Robin- son. The plaintiff all that Selby had been & boarder at her house, and, having failed to pay bis board he was notified to leave. In re- taliation for this notification he threatened to get even, and to do so entered the premises while Robinson's family were away andearned off the above enumerated articles.
