Seveaty-eight of the forged seven- thirty notes have been sent from here to the Assistant Treasurer in New York, and two more are retained by the Department in this city, The first of these counterfeits found its way into the Treasury on the 21st of Septem- ter, and up to this date no more than the cighty just mentioned have been passed by the exzpertsof the Government. So far, then, the losses by the frauds are $30,000 on the notes redeemed by the Treasury, ond an unknown sum beside on the false notes held elsewhere, which are variously estimated. The list of the forged securities is in the possession of the Assistant Treasurer, in New York. The re- port has been current that the Government has made a formal demand on the persons from whom the counterfeits were redeem7d, requiring payment of the money received for them from the Treasury. No such demand has been made as yet; bul the New York Pos! says that “several Interviews have taken plac? berween the Assistant Treasarer and the firms ininterest. There appears to be some doubt at Present as to what will be done. Tne questions involved are so large in their sweep, and con- nect themselves so closely with public confi- dexce and public credit, that as is nataral the various parties are looking up the decisions of the courts of law. And it is claimed in regard to the analogous reported cases in which coun- terfeit notes on itself have been presented to and paid by a bank, the rulings and decisiong are such that the Treasury having received and cancelled the counterfeit notes in dispute, can- not gO back upon the innocent holder from whom it got them, but can only have recourse to the counterteiter. The principle is an im- Portant one, And shonid be settled finally and witnout delay. Some stress is laid on the point made in 10 Wheaton, 333, where it is ruled mat although “a payment received in forged paper is not good when there has been no neg- ligence in the party receiving it, yet the prin- ciple does not apply toa payment made bona fide to @ bank of its own notes, which are re- ceived by it as cash and afterwards discovered to be forged.” Government Securities.
