Leé, who afterwards robbed the Gov- | erpment of 000, was the principal pros- | ecuting witness. It was said that Schoder sold two of the bonds to the cashier of the Kank of Schenectady, New York. He (Mr. K ) had taken Schoder ‘to tne cashier for iden- ification, and he had stated that he (S.) did not resemble the man who sold the bonds in auy particnisr, and he was not the man. Wheu arrested Schoder was a merchant doiug busmmess at Battle Creek, Michigan, and his property was seized by the Government, and is UL held. He was now on bail, but unable to obtain his property because of this indict- ment pending against bim, and be and his iumily are dvpendent on their friends. He was here to-day to ask when this prosecution would cease. Juage Cartter suggested that as che object of Mr. Riddle wasto enable the accused to ob- tain the possession of bis property Mr. Riddie's siatement should be accepted. Gen. Uarringzon entered a nol Mr. Riddle also called the attention of the Court to the fact that some constables had aot bonded under the law, and stated that be bad the bonds of them (whohad been employed about the Court House during the Surratt rial) whieb he desired permission to file. Mr. Riddle read from the act of Congress of March 3d, 1963, requiring constables on ap- poimtment to file a bond of $5,000, which sbali be renewed on the 3ist of June of each year.
