In the Circnit Court, yesterday, before Judge Alexander, a case of habeas borpus was heard which presented some extraordinary features. Upon the petition of George H. Perry and Eli- vabeth Perry, a writ of habeas corpus was iseued, directed to Edward Landers and Mar- garet Ferrell. requiring respondents to pro- duce in court the body of HesterLouisa Bart. ling, aged eight years, (alleged to be the dangh- ter of Mrs, Perry, one of the petitioners, before marriage,) who is detained from its mother by the respondents, The answerof Edw. Lan- ders, one of the respondents, alleges that the child is the daughter of bis wife, Margaret Landers, by a former husband, whose name wae Ferreil, and that the name ofthe child was Margaret Ferrell. Mrs. Perry testified that the ebild was born m the almshouee, before her marriage, that being unable to take care of it, she lett it witha woman named Mrs. Longh- Im, Who was to support it for $6per month, ind that $6 was paid her on acgount; that she ortiy after went to Frederick, ana on ber return found her child in possession of Mrs. Ferrell, at whose house she frequently visited it. Also, thatshe was married for the firat time in July. i660, to Mr. Perry. 1t was in evidence. also, that Mrs. Loughlin, with whom the child ‘was left by its mother, being unable to support it, and hearing nothing of its mother after the child was left ‘with her for over six months, attempted to place it in some asylum, but fail- ed. She then gaveti to Mrs. Ferrell, who adopted it, gave it her name, and fixed upon it certain property in Philadelphia. It was also im evidence that the child was claimed to be the daughter of Mrs. Ferrell before her present marriage, and thatits name was Margaret Fer- Fell. The evidence wasconflicting. After the examination of one or two witnesses, the re- spondents asked that the case be postponed until Saturday next toenable them to produce ‘witnesses, and the court granted the postpone- ment. The counsel for petitioners asked that the ehild, inthe meantime, might be kept in the custody of the sheriff, to prevent its being carried beyond the jurisdicton of the court. At this point Judge Alexander directed two ehairs to be placed at one end ofthe court. room. Hethen requested Mis. Perry, one of the petitioners, to take one of the seats, and Mrs. Ferrell, one of the respondents, the other. ‘The child during the hearing had been stand. ing upon the platform, at the sideof the judge. Judge Alexander then turning to the childand told it to goto its mother. The child started down and then turned around ard asked the judge, “Can I go to the mother I want!” The Judge said “Yes, child,” when she sprang for- ‘ward. and threw herself into the arms of Mrs, Ferrell, exclaiming: “This is the mother I want.” She was received with passionate Risses. During these proceedings, the eyes of the large number of women, as well &s men Present, were directed to the movements of the child, and when her choice was made, the women rose to their feet, and gave vent to their feelings in exclamations of delight. “The darling child,” says one. “She knows her mother,” says another. Sobs and tears accom- panied the demonstration. The countenances ©f men were not without emotion, and it was some time before the quiet of the court-room was restored. While this scene was being macted, Mrs. Perry, the petitioner, looked on, and soon atter ie{t her seat and took & chair beside her counsel, at the trial table. Judge Alexander then directed Mrs. Ferrell to take charge of the child, and produce her in court on Saturday next. He siso told the counsel that the child was in the custody of the court, and refused the application to place her in charge of the sheriff. Thomas a Hopkins and Wm. E. Duff, Esqs.. appeared as counsel for fhe petitioners, and L. P. D. Newman and J. a entz, Esqs., for respondents.—Balt. Sun, st. ————e Virginia News.
