teins THE TRIAL OF JOHN H. SURRATT. ——_—— ‘Thetrial of Jno. H. Surrat was resumed inthe Crimmal Court this morning betore Judge Fisher, the room being crowed as usual. The prisoner and jurors were brought in at ten o clock and the Court wasopened. After some delay, caused by search for paper: Mr. Bradley said he would first offer in evidence the time table of the New York Uen- tral railrosd for April, 1665, showing the trains then ieft Albany at7 o'clock a. m., and reached Syracuse at 4.20 p. m,, leaving Syra- cuse at Canadaigna at 4.52, Mr. Poerrepoint said they had agreed that the tables be admitted as the time tables of the road. but they did not agree that the trains arrived and departed at the times named. Mr. Merrick said he would ask the indal- gence of the Court to present &n authority in Tegard to reepening the question of admitting the register of ihe Webster House. He re- terred ihe Court to 12th Heward, U.S. Si preme Court’ reports, where a letter of a de- lendant was admitted. Sudge Fisher, after reading the same, said he supposed that letter must have had a posi- mark on it, or something on the inside, show- ing conclusively where {t came trom and by ‘whom it was written. He bad always seen Jeuers ruled out unless they bore & post-mark showing that they did come from the place and at the time from which they purported to come. They were admitted on posi-mark, because that was evidence made by Some one else at the time the letter was mailed. Mr. Bradie; aid an important witness, Mr Bushes, lett Montreal for this city on Tues- cosy. and it was expected that he would be here this morning, but nothing had been heard from him. Simce yesterday they had discovered the whereabou's of a gentleman of raspectability and cbaracter, who was at the Brainard House, in Elmira, on the 1th and 15th ef April, 1865 and there saw the prisoner atthe bar. 'This gentleman and M jushen were the ofty wit- nesses the defense now had to examine, aud they would then close their case. The rul- ings of the Court had excinded the testimony of a large number of witnesses which the de- fense bad. Mr. Merrick said the time had now arrived when tbe original evidence was at an end, the prosecution could now offer nothing except such testimony as rebuted that offered by de- tense. He therefore moved the Court to sirike from :he record all evidence which the prose- cution had offered to conmect others with the conspiracy but failed todo so. He asked that ihe evidence in regard to Jacob Thompson: the alleged shooting otf Union soldiers; the fight with some gunboat on the Potomac river; and the letter found floating on some river in North Carolina. be siricken from the evidence as the prosecution had failed to connee: them wiih | ihe conspiracy. Mr. Pierrepoin: said there were many things offered in evidence which would be connected aud make the chain perfect when the evidence was all reviewed. He did nat pfopose to dis- cuss {his question now, but would do so at the close of the case. As to the prosecution not having the righ! to offer new testimony as re- burting, he did not agree with the learned gen- Hleman on ‘he other side. The prosecuiion did have the right \o offer any tesiimony which they had the right to offer at first. The de- | tense had attempied ‘o prove that Surrat: was in Canandaizua, EJmira and Montreal, and the prosecution world show tha: he was noi chere. Mr. Carrington satd ihe only question before he Court was if certain items of ‘estimony should be s'ricken from the record. He thought ibis whole question should be suspended until allthe evidence was in. He thought the evi- deuce of the prisoner shooting down Union soldiers was counecied with ihe conspiracy, and it would be shown tothe satisfaction of ihe Cour: Richard Sutton sworn and exam'ed by Mr. Bradiey.—Witness ad muck experience in reading and examining handwriting. Witness was here shown the Toney letter addressed to Atzerodi, and testified he did not-think it was in the same handwriting as the leiter addressed to Weichman, signed by Surratt. Witness was here shown the telegrams of Booth, and testified he did not think they were inthe same handwriting as the Charles Selby letter. Cross-examined by Mr. Pierrepont.—Wit- ness did not think the Charles Selby levier was written in a patural band; witness did not profess to be an expert; witaess had not made it B study (o examine handwriting to see if writings were by the same persons. Mr. Pierrepont asked that this testimony be stricken out, as the witness did not profess to be an expert Mr. Bradley, jr, argued that the witness had | much experience, and was a judge of hand- writing. Judge Fisher said the witness did not profe: to bean expert, and he therefore ruled the tes- umoky out. Mr. Bradley suggested thatthe prosecution | go on, and the defence be allowed ‘o examine the two witnesses when they came in. Mr. Carrington said the prosecution could not consent to go on until the defence had all their festimony in. Jucge Fisher said, in view of the circum. stances, he was inclined to give the defence until to-morrow to close. The witnesses had a long distance to come, aud time should be given them. Mr. Rameburg presented « Petition asking for, the repair of a pump; re- ferred to the committee on water. Mr. Cla- bangh, from the committee on claims, reported resolution authorizing the payment of the claims of the Fire Department—295.47—for the year ending June 30, 1567; passed. Mr. Ula- bungh reported a resolution providing for the sule of grain nd potatoes by weight, and es. tablishing the following as the standarg weight of grain: Wheat, 60 Ibs.: corn, 58; rye, 56: oats, 32 poratoes, 4; and corn meal, 49 pounds per bushel. The resolution was passed. Mr. Pick- rei offered a resolution relative to water and 18 mains on Jefferson and Washington streets: passed. Mr. Ramsburg presented the report of trustees of the poor and ‘work-honse for the quarter ending June 3°, 1867, showing the total expenses to be $1,035.03, and re- ceipts =232; which was referred to the committee on the poor @nd work-house. Mr. Pickrell. from the joint committee to whom was referred the papers in relation to the removal of obstructions in the harbor, re- ported a resolution appropriating $10,000 (or so. mach ‘thereof as may be pecessary) for that purpose: which was unanimously passed. Mr. Pickrell. from the same joint committee, offered @ resolution encouraging the consiruc- tion of a railroad or other structure over the piers of the Alexandna aqaedqct. Mr. Thos. Brown opposed the passage of thé resolution unless it be so modified that the bridge be built seventy feet above the water. Mr. Pickrell and Mr. Clabangh favored the resolution with- ont an amendment. The resolution was passed. A resolution in relation to the repairs of the Upper Falls road, and appropriating therefor 10, and allowing 3 per day as a compensa- tion for a superintendent of the work, was passed. An ordinance relative to party walls and partition fences was reported by the com- mittee of conference. The report was con- curred in and the ordinance passed. Aresolu- uon appointing commissioners to establish the grade of streets was passed. A resolution in- structing the commissioner of streets to pro- ceed with all possible dispatch to make the improvemen: of Liacoln street was passed. A 1esolution in relation to the footways ot the town was approved and passed. A resolution relative to laying certain flag footways was concurred in as amended by the Board of Al- dermen, and passed. Map Doc.—Bridge street, near Washington, was the scene of much excitement yesterday afternoon, between 3 and 4 o'clock, by reason of a mad dog running loose, seeking “whom he might devour.” A crowd soon got at bis heels, and he sought refuge trom his pursuers in Mr. Field's oyster saloon, near the cornet of Washington street, much to the terror of the ladies of the family, who speedily fled toa back room, leaving the cur «master of the sit- uation.” At this juncture officer Volkman aj , and together with a colored man, en- the reom and endeavored to dispatch the infuriated animal, who appeared to be in qhe ‘worst siate of madness, snapping and snarling ai his ‘ormeniors.
