THE EVENING STAR. THE TRIAL OF JOHN H. SURRATT. The trislof Jonbn H. Surratt was resumed the Criminal Court this morning, before Judge Fisher, and the testimony for the de- fense continued. The prisoner and jurors having been brought in, the Court was opened, and— Jove) Carrol was recalled and cross-@xam~ ined by My. Pierrepoint.—Witness knew Mr. kcnapp and Mr. Cobell—saw them in the Court room and poiated them gut; saw aman pres- ent, heard it said bis mame was Roberts; had no conversation with bim in Elmira. Hada conversation with Mr. Knapp in Elmira. Did not remember of seeing Mr. Roberts with Mr. Knapp. Witness told Mr. iknanp be thought he could identity the man. Witness did not say Surratt wasa | tailor. Did tell Mr. Knapp be saw the pris- ouer in Elmira on the Lith and 14th of April, 1865; did not remember particularly. Did not remember of telling him it was the 1@ta. To the best of his memory witness said he saw him on the 13th and 14th; told Mr. Cobell the same thing. One of the proprietors of the store where witness was employed left on the evening of the 12th and returned on the morn- ing o the I5tb. that was how witness fixed the date. Witness saw Mr. Cobell almost every day while in Elmira; bad talked with him about this thing more than once. Saw Mr. Knapp & number of times; had talked with him more than once on this subject. Had seen a man with Knapp who ft was aid was a detective, but witness did not ow him. Had seen a man with Cobell beard it said that he was a_ detective. Witness saw the prisoner in che jail; told Co- bell after, that he identified him; never told Cobeli he could not identify him; never told obeil, Knapp, and Roberts, that he could not idenufy him. ‘The store where witness was employed was not closed on the 4th of April: did not remember what time be went to the store; the prisoner came in tne store on the 13th. ‘Witness told him he did not have the goods he ‘wanted then, but Mr. Offutt. one of the pro- prietore, was in New York. and witness told im he ‘might send the goods, and they might be thereon the next day: the prisoner called again on the 14th, and inquired if those goods had come. Witness replied, no. Witness was sure he never told any one he could not recog- nize the prisoner; never told either Knapp or Cobell that be asked the man if his name was Surratt, and he replied that it was. Witness first heard his name was Surratt a short time betore coming here. Witness had nosuspicion abont him; treated bim as any other customer. Did ask bim if he was @ Southerner, and he replied he was: butdid not ask his name. By Mr. Bradley.—The man came from the direction of Water etreet; the Brainard house, now called the Rathbone house, was on Water street: witness saw Major Foster in the cars but never had any conversation with him: was told last evening that Roberts was a detective; had @ conversation with Knapp yesterday, after leaving the court héuse, abont | Surratt being a tailor. Merrick —Witness in April, 1865, resided at Mrs. Surratt’s house. Knew Mr. Weich- men, Miss Fi:zpatrick, Mr. and Mrs. Hollohan snd Anna Surratt,and knew John Surratt. John Surratt was not about the house on Good Friday, the day of the assassination. Saw him about two weeks previous to that on Monday evening. Miss Fitzpatrick got his supper. Witness took s walk with Mrs. Surratt and others, when Mrs. Surratt stopped at the Herndon House, Miss Anna Surratt went with her. Miss Fitzpatrick. Mr. Weichman ind Witness walked down the street a short distance. Mrs. Sntratt did not say who she was going to the Herndon House to see. Djd not say she was going to cee Payne. John Z, Jeniins sworn, and examined by Mr. Bradley.—Witnees was a brother of Mrs. Sur- ratt. Saw her at Surrattsville on the day of the assassination. Sheshowed witness @ letter Which she had received from Mr. Calvert. Her business was with Mr. Nothey, and she got Weichman to write a letter for Mr. Gwyon for him to see Mr. Nothev. Jross-examined by Mr. Pierrepoint :—Mr. Nothey lived about five miles from Surratts- ville, towards Piscataway. At fifteen minates past 12 o'clock, the court took a recess for fifteen minutes. On reassembling at 12 35— Mr. Bernard J. Early was sworn for the de- fense and examined by Mr. Bradley.— Witness knew Micnael O’Laughlin, and saw him on the morning of the day of ‘the assassination. At7o’clock in the morning saw him at the Metropolitan Hotel in his reon,and aroused him. TLey went down stairs and hada drink, and O’Laughlin afterwards came down. and with the party got shaved. Then went to Welcker’s restaurant and got breakfust. After breakfast went down the avenue to the Ni tional. Murphy stopped at the Metropolitan. O’Laugblin went up stairs to see a friend. After waiting tor him, sent a card tothe room, and the waiter returned, saying that he had gone. O’Laughlin had on a plam-colored coat, striped pants, and slouch hat. Edward A. Murphy sworn for defense aud examined by Mr. Bradley. Witness resides here, and is engaged in the plumbing business. Witness corroborated the testimony of the preceding witness, he being one of the party with whom O'Laughlin was on the morning of the day of the assassination. Wm. Failing sworn for the defense and ex- amined by Mr. Bradley.—Witness lives in Canandaigua, and kept the Webster House. in that city. Was there in April, 1865. Witnes identified the register of the house. Witness clerk at that time was Mr. Pratt. Witness found signature of John Harrison, New York. under the date of April 15th. The names ot the parties were registered in regular order. Witness is not sare that be was at the house in | the early part of the evening. The train from Elmira arsived at 9 or 10 o'clock at that time. The name of Harrison is the last entered on that day, with the exception of two. Mr. Bradley proposed to offer the register in evidence. CUross-examined by Mr. Pierrepoint.—Wit- nese thinks that he was at home on the day of the assassination, and the day after. The book has remained in the hands of Mr. Chamber- lin, to whom he sold out, until a few weeks since. Had not seen the book since until to- day. Witness was Banded the ch: cks or night book, but failed to find by it whether tie per- son who registered bis name as Harrison had room assigned him. Witness never saw the book examined. Don’t recollect who wrete the name, or anything about it. Mr. Pierrepoint objected to the register be- ing admitted in evidence. Fronk ©. Chanerlain sworn for the defense and examined oy Mr. Bradley.—Witne-s now keeps the Webster House im Canandaigua, baving bougbtout Mr. Failing. Witness’ at- tention was called to the entry of John Harri- son ut Canandaigua by Mr. Bradley, Jr. There ‘Was no alteration about the book that he could see. Cross-examined by Mr. Pierrepoint.. ness took possession of the hotel on the 17 April; the book laid on the desk, and was used tothe 3ist of December, 1=65: it was then placed under the desk, on a sbelf, where it remained until it came here: it was open toanybody, «nd @ person may have written in it; there were vacant lines in the book where names could be inserted: could not say that the book had been taken away; Mr. Bradley, jr.. calied Witness’ attention to the entry in the book on the 23d of May; Mr. Bradley summoned wit- ness, and said be had been there twice and ex- amined the book unknown to witness. Jos. H. Brodley, Jr. sworn for the defence.— From infermation recetved from the prisoner went to Canandaigua, arriving on ihe 16ta of March. and went direct to the Webster House, where he registered hisname. Looked around the office and found the book, which was in precisely the same condition as now, and un der date of April 15th, found the name of Har- Tison. Went to Canandaigua the second time, arriving about the 22d or 23d of May. and again looked at tne book. Spoke to Mr. Chamber- lain in reference to tke book, and summoned him Mr. Joseph B. Bradley, Sr, sworn.—Witness testifled that the book was precisely in the con- dition it was when Mr. Failing delivered ii to him, about three weeks since. Mr. Bradley asked if the Court had any | donbts abont admitting it in evidence. The Court said that the entry may have been made subsequent tothe 15th of April by the prisoner, and before the 17th of September. Mr. Bradley remarked that the prisoner was concealed in Canada at this period, according to the testimony of Dr. McMillan. He did not offer this, except as tending to show that the prisoner was at Canandaigua. The Court here examined the books, and Mr. Bradiey called atiention to. the tact ‘hat sev- eral leaves had been torn from the check or night book, and that book had been packed | away until it was placed in the hands of the Government Mr. Merrick proceeded to argue that it was impossible for the prisoner to Rave made the entry from April to December: in the course of his remarks, notmg the fact that ali commu- nication with the prisoner had been prohibited, and he had been debarred the use of pen. ink, and paper. He (Mr. M.) was glad for some reasons that such was the case, for by it certain members of Congress who appeared to be very anxious to getin his company had been pre- vented. for they did not want any prowling ground bis cell. He believed that the Court had given this order at the suggestion ot the prisoners counsel. He contended that it Was mot necessury, as the prosecution con tended, that i: should be shown ‘iat th prisoner wrote the name, and read to shov that the courts were breaking down techni- calities of the law, from 3d Wallave. 131. The prosecution had offered in proof a pocket bandkerchief to show that the prisoner was in a certain place. when at the time they knew tbat it bad not been dropped tnere by him, and it was admitted. The detence now had some- thing better than & handkerchiet Mr. Pierrepoint replied, sayine that “could the eignainre be offered in evidence, his decla- rations could also be offered in evidence. For full five months the register laid on the desk, and the prisoner, lying within twelve hours of Canandaigua, could, in some ofthis disguises, have gone to that place and mannfactured ey dence. Mr. Bradley asked to refer to the tact that yesterday they had offered testimony to prove ‘tbat be was in Elmira. THE GEEMAN SABNGERBUND AND ARI Soorerizs.—The Saengerband Suciety, num- bering twenty-six members, and Arion Quar- tette Club, composed of twenty members, left this city at 12 o’clock to-day, to attend the Singing Festival, at Philadelphia. which com- mences on Monday next, and will continne throughout the week. Prior to their depart- ure, the members of the Ssengerbund Associ- ation @ssembled at their hall on Pennsylvania Svenue where the president, Mr. L. Waldec- ker, was presented with a most tiful silk of the So- ik, attached ilk rosette of rea, white and biue ribbon, bearing agold star in the centre, ana the edges encircled with goldfringe. The pre- sentation speech was made by Mrs. Hager- mann in behalt of the ladies, and an approori- ate acknowledgement was made by Mr. Wal- decker, both of whom spokein German. At the close of the presentation, the Arion club arrived at the Saengerband's Hall, where re- freshments were partaken of, after which both societies formed in procession and Warched to the depot, to the cars for Philadelphia, headed by Bergman's Metro- politan cornetband. About 150 of our German Citizens, who have been preparing for the event, left with these societies on the 12.15 train. It is expected that the Saengerfest this season will eclipse anything of the kind which has yet been witnessed in this country. Que hundred and twenty socleties will be present on the occa-ion, and from the city ot New ‘York alone there will be sixteen hundred members—all good vocalists. The officers of the Saengerbund Society here lent; Charles Rich- . Hagermann, secretary. Those ot the Arion Club are: Mr. Heinrich president; Mr. Springsguth, sectetary; and C. Bergmann, lead eek Vessst Burnt at SEA—Narrow Escape of the Officers and Crew from Drowning.—The schooner Silvan, Capt. Blanehard, from Ban- gor, Maine, which arrived at Brown's whart this morming, reports that about mid-day of the 7th ingtant, seventy-five miles northeast by east of Uape May, they espied a small boat filled with persons. who seemed to be in dis- tress. Upon approaching the same it turned out that the party consisted of the captain and crew of the schooner Bergen, which was to- tally destroyed by fire on the night of the 6th. The Bergen was from Oharleston, South Car- olina, and was heavily laden with cotton, moss, rosin, &e. The fire occurred in the hold of the vessel, and so rapidly did the flames ‘pread in different directions that no one on board had time to save any clothing except ‘what they had on. Immediately upon its dis- covery their perilous eituation was apparent, and forthwith the small boat was lowered, and all hands descended into it. Fortunately a comparative calm prevailed, a'though the night was dark and a driving rain was coming down. Had it been otherwise, and the sea had | been at all disturbed. the anxious party must have all perished: for the weight of them sei- ted the frail craft so deep into the water that scarcely an inch of her gunwales were above the surface of the river, and the greatest cau- tion was necessary lest the slightest motion might settle her to the botiom of the ocean. ‘The Captain of the Bergen is named Parsons. that of the mateis John R. Mitchell, and the crew are composed of Jesse Scott, Jesse Ames, LeviCnbase, and James Jackson. Capt. Par- son’s wite and daughter were on board. as also was one passenger. Much praise is due Capt. Blanchard, of the Silvan, fer his unre- mitting efforts to render the rescued party from the Bergen as comfortable as possible.
