Surratt, indicted for the murder of Abrabam Lincotn, late President, &., and filed the following motion: To the Honorable the Judge of the Criminal Conrt cf the District of Columbia: Jonn H:Sar- ratt, by bis counsel, respectfally showeth That in the moath of October last he was ar- rested in ried and placed on beard an armed vessel of the United States, and from that time forth was kept in close confinement, heavily ironed, allowed only for a brief timke ocea- sionally to breathe the fresh air; wholly ex- eluded from all intercourse with any hu- man being bat those who were employed to administer to his absolute needs, without change of external raiment obliged to wear the very dress in which Be was arrested, and thus kept Im prison until the month of Febru- ary, when be was transferred to the jail in the city of Washington, in which jail he has been ever since and still is confined. It thus appears, and the fact is placed be- yond doubt by official records, that the prose- cation bas bad the fullest notice, and the amplest means to prepare for the trial of this cause at this second term of the Uourtafter the prisoner's arraignment, and can have no Feasonable ground upon which to ask its fur- ther postponement. Immediately after his are raignment the became began to prepare for tense, and from time te time his connsel bave notified the District Attorney and his aesistant of the progress of that Preparation, and that the uncertainty of bei; able to get bereoue partucular witness alone prevented their fixing a day for the trial. More than two wreks ago they informed them that they had discovered where that witness was, and tbat they would be ready tor trial im two weeks time. Nearly a week ago they moved in this honorable court to have a day set down for the trial of the cause, and it was resisted, and @ motion thereupon made by ibe prosecuting attorney tha: the cause be continued. The means of the prisoner have been utterly exhausted in seeking the evidence to establish beyond all doubt his perfeet innocence of the charges preferred against him: to show to all the world that be is free from any stain of guilt er complicity in or comntvance at, or «vem 8 suspicion of the terrible tragedy with which the proseention seeks to convict nim. He is now ready. He chauenges the enquiry, and in the name of justice, hamanity, and the due administration of justice to all, wh: er their condition in life, by the law of the land and under the bill of rights, the charter of our liberties, be demands a speedy trial—a (rial at this term of the cour’, and that he shall not, if innocent. be held longer in close confinement, rejected and abborred by men as thougo guilty, and day by day deprived of the means by which he will vindicate his name and establish bis right to walk abroad as a tree man. The counsel for the prisoner, therefore, comes imto court and prays your honor w overrule tbe motion of the District Attorney for the further continuance of the cause, and asks that you will designate some dayat the presert term of the court fur the trial thereof, Jos. Sarratt Mr. Carrington spoke of the kind treatment Surratt had received, and said it was not mece-sary to submit to the motion of counsel, &s requested. At the proper time he should be able to proceed with the case. and was willing that he should have a speedy trial: Which would be as soon asthe interests of accu-ed and the Government could be proper- ly consulted. He expected at the trial to be able to satisfy the jury, the court, and all the world that Surratt was guilty as indicted. Since their organizatton the band has given twe remarkably successful conceris; and if they continue to improve in the same ratio the band will soon take rank with the best bands of the country.
