And be it further enacted, That section Sifteen of the “Act to increase the present mil- itary establishment of the United States. and for otner purposes,” approved July fifth, eighteen hundred and thirty-eight, be amend- ed so that venereal officers shall not hereafter be exciuded from receiving the additional ra- tiom for every five years’ service; and it is hereby further provided that officers on the reured listof the army shall have the same allowance of additional rations for every five years’ service as officers in active ser vice. Approved, March 2, 1867. . [PuBLic—No. 65.] AN AcT amendatory of «An act to provide a temporary government tor the Territory of Montana,” approved May twenty-six, eigh- teen hundred and sixty-four. Be it enacted by the Senate and Honse of Rep. resentatives of the United States of America in Congress assembled, That the legisiative assem- blies of the several Territories of the United States shall not, atter the passage of this act, grant private charters or special privileges, but they may, by general incorporation acts, permit persons to associate themselves togeth- er as bodies corporate for mining, manufactur- ing, and other industrial pursuits. SEC. 2. And be it further enacted, That the probate courts of the Territory of Montana, in their respective counties, in addition to their probate juriediction, are hereby anthorized to near and determine civil causes wherem the damage or debt claimea does not exceed five hundred dollars, and such criminal cases aris- ing under the laws of the Territory as do not require the intervention of a grand jury: Pro- vided, That they shali not have jurisdiction in any Matier in contreversy when the title or Tight to the peaceable possession of land may be indispute orcbancery or divorce causes: And provided further, That in all cases an appeal may be taken from any order, judg- ment, or decree of said probate court to the district court. Sec. 3. And be it further enacted, That the ehief justice and associate justices of said Ter- ritory and the Territory of Idaho shall each re- ceive an annual salary of thirty-five hundred dollars. Sec. 4. And be it further enacted, That the judges of tne supreme court of said Territory, oF a majority of them, shall, when assembled at | the seat of government of said Territory, de- fine the judicial districts of said Territory, and assign the judges who may be appointed tor said Territory to the several districts, and shall also fix and appoint the times and places for holdin ¢ courts in the several counties or subdivisiens in each of said judicial districts, and alter the times and places of holding the courts as to them shall seem proper and conve- nient, but not less than (wo terms shall be held at each place of hoiding court each year Sec. 5. And be it further enacted, That for the purpese of reviving the legisistive func- tions of the Territory of Montana, which have been adjudged therein to have lapsed, the governor of said Territory be, and he is hereby, sutborized, on or before the first day of J uly, eighteen hundred and sixty-seven, to divide said Territory into legislative districts for the election of members of the council and house of representatives, and to apportion among said districts the number of members of the legislative assembly provided for in the or- ganic act of said territory, and the election of said members of the legislative assembly shall be held at such time and shall be conducted in the manuer prescribed by the legislative as- sembly of said Territory at the session thereof, begun and holden at the city of Bannack, in eighteen hurdred and sixty-four and eighteen hundred sixty-five, and the qualifications of voters shall be the same as that prescribed by said organic act, saving and excepting the dis- unction therein made on account of race or color, and the legisiatiye assembly, 20 elected, sball convene at the time prescribed by said legislative assembly at the session last afore- said. The apportionment provided for in this section shall be based upon snch an enumera- tion of the qualified electors of the several! le- gislative districts as shall appear from the election returns in the office of the secretary of said Territory, and from such other sources of information es will enabie the governor, with- out taking anew census, to make an appor- tionment which shall fairly represent the peo- ple of the several districts in both houses of the legislative assembly, but the legislature may at any time change the legislative dis- tricts of the Territory as fixed by the gevernor SEC. ti. And be itfurther enacted, That all acts Cs at the two sessions of the so-called egislative assembly of the Territory of Mon- tana, held in eighteen hundred and sixty-six, are hereby disapproved and declared null and avoid, except such acts as the legislative as- sembly herein authorized te be elected shall by special act in each case re-enact: Pryeiled, however, That in all claims of yested rights thereunder, the party claiming the same shall not, by reason of anything in this section con- tained, be precluded from making and testing said ciaim in the courts of said Terrwory: And provided further, That no legislation or pretended legisiation in said Territory since the adjournment of the first legisiative assem- bly shali be deemed valid untit the election of the legislative assembly herein provided for sball take place.
