Coilee went toa barber's Sajoon about 9 a. m., with a iriend, and after beiug shaved, paid the barber tor himself and friend. He then saw in his pocket- book a $60 pote which he had, and closed his pocket-book and put itin his pocket. About 1245 o'clock he went to Dr. W. B. Shedd’s Tooms, on Sih. near F, to take a yapor batn. There be was conducted te the bath-room by the accused, and taking off his clothing, left it upon a lonnge in the room in careof the young man, and entered the bath, from which he except through «small window, covered bya curtain. The bath was attended by the ac- cused, and the witness did not know that any other person entered the room. The young maa left the room for a few minutes, as he said to correct something amiss im the stove- room, which was the only time he wasabsent. When the witness came out of the bath and dressed, be took out gis pocket-book to pay the fare. and then missed the $5) note, and found that bis smaller money,a ten, a five, and some smaller notes, were lett. He notified Dr Shedd, who called his son and searched him, butthe money was not found. Thede- femee showed that while the Colonel was in the bath, Dr. Shedd and another gentieman had been in the room inspecting the arraugement. That no such charge had betore been made against the young man, nor had others lost Valuables in the house, though many had been meee im charge of the same person. Justice ucker remarked that the circumstances were Unfortenately suspicions, and pointed most atrectly to the young man; but admitting tuat the Colonel aciuai rried the money to the bath-room, and it was stolen there, there is no more evidence to show that the acensed took it, than that ether of the others who were in the room The money bas not been found, though the detective inspected the premises, and the accused has been searched.
