The ques- tions certified In this case, and two other cases beard with tt, were as follows 1. On the facts stated in saia petition and ex. hibits, ought a writ of habeas corpus to be issued according to the prayer ofenid petition? *. On the facts stated in said petition and ex. hib onghbt the said Lembdin P. Milligan to be discharged from custody as in said petition prayed 3. Whether, upon the facts stated in «aid Petition sud exhibits. the military commission Mentioned therein bad jurisdiction legatly to '¥ and sentence said Milligan im manner and form as in said peution and exhibits siated. As to tha first two questions. it is answered affirmatively, and as tothe thira question it is answered in the negative Mr. Justice Davis read the opmion of the court. On the merits, it is held that Congress provided against such commissions rather ‘ban in invor of them, by the act of 1363, and that Congress Bas not the constitutional power to authorize such commissions. That the Con- sti'utlem is expressly agsinst them, and it ix the supreme law of the lund in umes of war Ss in times of pesce. Mr. Chief Justice Chase read an opinion (im which Justices Wayne, Swayne,and Miller concur) dissenting from so much of the opimion of the court as held that Congress did not have the constitutional power to sathorize military commissious, but concurring as to the answers given to the questions certified up. Yesterday, Sergeant franklin arrested } G. McGlauhblin, and officer Howes arrested Frederick Gentey, both of the Third Ward, for keeping open their piaces of business on Sun- day. They were taken before Justice Morse who fined each $20. John Killian ed by officer Greer. of the Second Ward, for a iike offence, anc was fined $10 by the same Justice. Other warrants have been served and the parties have ruled the cases for trial. > IMPOSITION OW THE FRERDYEN.—On Friday morning, from two to three hundred freedmen ‘were gathered about the Old Capitol. much to tbe surprise of all who saw them, and it ap- peared from what they stated that some whiue ‘Woman bad been gomg around among them circulating & report that the Government had a large quantity of rebel clothing which had been stered in the Old Usapitol, and which on the day above named she was to distribute. It appeared also, that on the strength of the mis- representations she had borrowed small sums of money fromthem. The woman was punc- tual at the time appornted, and went mto the building: but suddenly exclaiming that she had Jeft the key of the room at home, she left to get it, and has not yet returned. —_——o—_—_—_. Jos BILiines as a LECTURER aT MeEr- ZEROTT HaLt.—This sarcastic individual will “lectur”’ at Metzerott Hall on Wednesday (to- morrow) evening, for the benefit of the relief fund of the Soldiers and Sailors’ Union, of this city. Weare pleased that our citizens have the opportunity of enjoying themselves, and at the same time contributing to the comfort of 2 large class of destitute persons in our midst. We understand that the board of relief having charge of the fund referred to, relieved about 40 persons, at an outlay of $304, m October last. and abont 75 persons, at an outlay of $535, in November. None who go are likely to be disappointed, as the genuine wit and humor of the lecturer are calculated to satisfy the most exacting demands. —_———_—— STATUETTE OF MR. LINcoLy.—The statuette of Mr. Lincoln, by Swayne, now on exhibition at Galt’s jewelry store, has many points ot excellence, and by some is preferred to any model yet made of the mart; President. The artist bcs selected one of the most inter- esting events in the most heroic period of Mr. Lincoln's administration—the reading of the second Inaugural Address. Mr Swayne, who had good opportunities for studying his sub- ject, has aimed to mold the peculiar features, to catch the half sad, nalf smiling expression of Mr. Lincoln, and to combine a good likeness and an easy pose. a Tse Masowic Fain.—The interest in this ‘worthy enterprise is rapidly increasing, and Visitors upon each succeeding visit discover some new attractions. Upon a stage at the north end of the ball are to be seen several fine statuettes, executed by Vinnie Rear, and the first piano made in this city, the latter being an excellent piece of workmanship and highly creditable to the manufacturers, pon one of the tables are, three fine pictures of the jate President Lincoln, General U. S. Grant, and General Robert E. Lee, respectively. These pictures will be raffled for $1 per chance.
